A bill to be entitled
2An act relating to the conveyance of bodies into or out of
3the state; amending s. 406.61, F.S.; authorizing
4accredited entities to convey plastinated bodies or parts
5of bodies for certain purposes; requiring accredited
6entities to provide prior notification to the anatomical
7board and submit certain information and documentation to
8the board; providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:
11
12     Section 1.  Section 406.61, Florida Statutes, is amended to
13read:
14     406.61  Selling, buying, or conveying bodies outside state
15prohibited; exceptions, penalty.--
16     (1)  Any person who sells shall sell or buys buy any body
17or parts of bodies as described in this chapter or any person
18except a recognized Florida medical or dental school who
19transmits shall transmit or conveys convey or causes cause to be
20transmitted or conveyed such body or parts of bodies to any
21place outside this state commits is guilty of a misdemeanor of
22the first degree, punishable as provided in ss. 775.082 and
23775.083. However, nothing in this chapter does not prohibit
24shall be construed as prohibiting the anatomical board from
25transporting human specimens outside the state for educational
26or scientific purposes or prohibit as prohibiting the transport
27of bodies, parts of bodies, or tissue specimens in furtherance
28of lawful examination, investigation, or autopsy conducted
29pursuant to s. 406.11. Any person, institution, or organization
30that conveys bodies or parts of bodies into or out of the state
31for medical education or research purposes shall notify the
32anatomical board of such intent and receive approval from the
33board.
34     (2)  Any entity accredited by the American Association of
35Museums may convey plastinated bodies or parts of bodies into or
36out of the state for exhibition and public educational purposes
37without the consent of the board if the accredited entity:
38     (a)  Notifies the board of the conveyance and the duration
39and location of the exhibition at least 30 days before the
40intended conveyance.
41     (b)  Submits to the board a description of the bodies or
42parts of bodies and the name and address of the company
43providing the bodies or parts of bodies.
44     (c)  Submits to the board documentation that each body was
45donated by the decedent or his or her next of kin for purposes
46of plastination and public exhibition, or, in lieu of such
47documentation, an affidavit stating that each body was donated
48directly by the decedent or his or her next of kin for such
49purposes to the company providing the body and that such company
50has a donation form on file for the body.
51     Section 2.  This act shall take effect July 1, 2009.
