| 3 | practitioners; amending s. 893.02, F.S.; redefining the |
| 4 | term "practitioner" for purposes of the Florida |
| 5 | Comprehensive Drug Abuse Prevention and Control Act to |
| 6 | include certain advanced registered nurse practitioners; |
| 7 | providing a contingent effective date. |

| 9 | Be It Enacted by the Legislature of the State of Florida: |
| 10 |
|
| 11 | Section 1. Subsection (20) of section 893.02, Florida |
| 12 | Statutes, is amended to read: |
| 13 | 893.02 Definitions.--The following words and phrases as |
| 14 | used in this chapter shall have the following meanings, unless |
| 15 | the context otherwise requires: |
| 16 | (20) "Practitioner" means a physician licensed pursuant to |
| 17 | chapter 458, a dentist licensed pursuant to chapter 466, a |
| 18 | veterinarian licensed pursuant to chapter 474, an osteopathic |
| 19 | physician licensed pursuant to chapter 459, a naturopath |
| 20 | licensed pursuant to chapter 462, or a podiatric physician |
| 21 | licensed pursuant to chapter 461, or an advanced registered |
| 22 | nurse practitioner licensed pursuant to s. 464.012 whose |
| 23 | practice is in a county that complies with the Department of |
| 24 | Health's electronic system for monitoring the dispensing of |
| 25 | controlled substances, if provided such practitioner holds a |
| 26 | valid federal controlled substance registry number. |
| 27 | Section 2. This act shall take effect July 1, 2009, if HB |
| 28 | 143 or similar legislation establishing an electronic system for |
| 29 | monitoring the dispensing of controlled substances is adopted in |
| 30 | the same legislative session or an extension thereof and becomes |
| 31 | law. |
