A bill to be entitled
2An act relating to breast cancer detection and screening;
3creating s. 381.932, F.S.; providing definitions;
4establishing a breast cancer early detection and treatment
5program within the Department of Health; providing
6purposes of the program; requiring the department to
7provide certain screening services to specified
8populations; requiring the State Surgeon General to submit
9a report to the Legislature; requiring organizations
10providing services to underserved women to submit a report
11to the department; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:
14
15     Section 1.  Section 381.932, Florida Statutes, is created
16to read:
17     381.932  Breast cancer early detection and treatment
18referral program.--
19     (1)  For purposes of this section, the term:
20     (a)  "Breast cancer screening and referral services" means
21necessary breast cancer screening and referral services for a
22procedure intended to treat cancer of the human breast,
23including, but not limited to, surgery, radiation therapy,
24chemotherapy, hormonal therapy, and related medical followup
25services.
26     (b)  "Unserved or underserved populations" means women who
27are:
28     1.  At or below 200 percent of the federal poverty level
29for individuals;
30     2.  Without health insurance that covers breast cancer
31screenings; and
32     3.  Nineteen to 64 years of age, inclusive.
33     (2)  There is established, within existing appropriations,
34a breast cancer early detection and treatment referral program
35within the Department of Health. The purposes of the program are
36to:
37     (a)  Promote the screening, detection, and treatment of
38breast cancer among unserved or underserved populations.
39     (b)  Educate the public regarding breast cancer and the
40benefits of early detection.
41     (c)  Provide counseling and referral services for persons
42seeking treatment.
43     (3)  The program shall include, but not be limited to, the:
44     (a)  Establishment of a public education and outreach
45initiative to publicize breast cancer early detection services
46and the extent of coverage for such services by health
47insurance, the benefits of early detection of breast cancer, and
48the recommended frequency for receiving screening services,
49including clinical breast examinations and mammography.
50     (b)  Development of professional education programs that
51include information regarding the benefits of the early
52detection of breast cancer and the recommended frequency for
53receiving a mammogram.
54     (c)  Establishment of a system to track and followup on all
55women screened for breast cancer in the program. The system
56shall include, but not be limited to, the followup of abnormal
57screening tests and referral to treatment when needed and
58tracking women to be screened at recommended screening
59intervals.
60     (d)  Establishment of a system to monitor participating
61providers of breast cancer screening for compliance with
62national and state quality assurance standards.
63     (4)  The Department of Health shall provide unserved or
64underserved populations, within existing appropriations and
65through contracts with health care providers, clinical breast
66examinations and screening mammograms, as recommended in the
67most current breast cancer screening guidelines established by
68the United States Preventive Services Task Force.
69     (5)  The State Surgeon General shall submit an annual
70report to the appropriate substantive committees of the
71Legislature. The report shall include, but not be limited to, a
72description of the rate of breast cancer morbidity and mortality
73in this state and the extent to which women are participating in
74breast cancer screening.
75     (6)  The organizations providing the testing and treatment
76services under this section shall report to the Department of
77Health the names of the insurer of each underinsured woman being
78tested to facilitate recoupment of expenditures.
79     Section 2.  This act shall take effect July 1, 2009.
