| 2 | An act relating to motor vehicle emission standards; |
| 3 | amending s. 316.2937, F.S.; ratifying a rule of the |
| 4 | Department of Environmental Protection which adopts the |
| 5 | California motor vehicle emission standards; requiring the |
| 6 | Department of Environmental Protection and the Department |
| 7 | of Highway Safety and Motor Vehicles to develop a proposal |
| 8 | to implement the rule and report to the Legislature; |
| 9 | providing an effective date. |

| 11 | Be It Enacted by the Legislature of the State of Florida: |
| 12 |

| 13 | Section 1. Section 316.2937, Florida Statutes, is amended |
| 14 | to read: |
| 15 | 316.2937 Motor vehicle emissions standards.--Rule 62- |
| 16 | 285.400, Florida Administrative Code, adopted by If the |
| 17 | Department of Environmental Protection, as filed with the |
| 18 | Secretary of State on January 26, 2009, is proposes to adopt the |
| 19 | California motor vehicle emission standards, such standards |
| 20 | shall not be implemented until ratified by the Legislature. If |
| 21 | the department proposes to modify its rule adopting the |
| 22 | California motor vehicle emission standards, such rule |
| 23 | modifications may shall not be implemented until ratified by the |
| 24 | Legislature. The Department of Environmental Protection and the |
| 25 | Department of Highway Safety and Motor Vehicles shall jointly |
| 26 | develop a proposal to implement the Florida Clean Car Emission |
| 27 | rule which addresses methods for monitoring compliance with the |
| 28 | rule, and shall submit the proposal to the President of the |
| 29 | Senate and the Speaker of the House of Representatives by |
| 30 | January 2, 2010. |
| 31 | Section 2. This act shall take effect July 1, 2009. |
