Section 794.052, Florida Statutes, is created to 6 read: 7 794.052 Sexual battery; notification of victim’s rights and 8 services.— 9 (1) A law enforcement officer who investigates an alleged 10 sexual battery shall: 11 (a) Assist the victim in obtaining medical treatment, if 12 medical treatment is necessary as a result of the alleged 13 incident, a forensic examination, and advocacy and crisis 14 intervention services from a certified rape crisis center. 15 (b) Advise the victim that he or she may contact a 16 certified rape crisis center from which the victim may receive 17 services. 18 (2) The law enforcement officer shall give the victim 19 immediate notice of the legal rights and remedies available to a 20 victim on a standard form developed and distributed by the 21 Florida Council Against Sexual Violence in conjunction with the 22 Department of Law Enforcement. The notice must include the 23 resource listing, including telephone number, for the area 24 certified rape crisis center as designated by the Florida 25 Council Against Sexual Violence. 26 Section 2. This act shall take effect July 1, 2009. 27 28 ================= T I T L E A M E N D M E N T ================ 29 And the title is amended as follows: 30 31 Delete everything before the enacting clause 32 and insert: 33 34 A bill to be entitled 35 An act relating to sexual battery; creating s. 36 794.052, F.S.; requiring each law enforcement officer 37 who investigates an alleged sexual battery incident to 38 assist the victim in obtaining medical treatment if 39 medical treatment is necessary, a forensic 40 examination, and crisis-intervention services from a 41 certified rape crisis center; requiring the law 42 enforcement officer to advise the victim that he or 43 she may contact a certified rape crisis center for 44 services; requiring the law enforcement officer to 45 immediately notify the victim of the legal rights and 46 remedies available to a victim of sexual battery; 47 directing that the notice of rights and remedies be 48 written on a standard notice form developed and 49 distributed by the Florida Council Against Sexual 50 Violence and the Department of Law Enforcement; 51 requiring the notice to include certain information; 52 providing an effective date.
