Florida Senate - 2009 SB 1320 By Senator Bullard 39-01607-09 20091320__ 1 A bill to be entitled 2 An act relating to school bus stops; amending s. 3 1006.22, F.S.; prohibiting school bus stops from being 4 located directly on certain state-maintained roads; 5 providing for phased-in implementation; providing an 6 effective date. 7 8 Be It Enacted by the Legislature of the State of Florida: 9 10 Section 1. Paragraph (c) of subsection (12) of section 11 1006.22, Florida Statutes, is amended to read: 12 1006.22 Safety and health of students being transported. 13 Maximum regard for safety and adequate protection of health are 14 primary requirements that must be observed by district school 15 boards in routing buses, appointing drivers, and providing and 16 operating equipment, in accordance with all requirements of law 17 and rules of the State Board of Education in providing 18 transportation pursuant to s. 1006.21: 19 (12) 20 (c)1. Each district school board shall establish school bus 21 stops, or provide by district school board rule for the 22 establishment of school bus stops, as necessary at the most 23 reasonably safe locations available. Where unusual traffic 24 hazards exist at school bus stops on roads maintained by the 25 state outside of municipalities, the Department of 26 Transportation, in concurrence and cooperation with and upon 27 request of the district school board, shall place signs at such 28 bus stops warning motorists of the location of the stops. 29 2. To provide safe locations for school bus stops for the 30 loading and unloading of students, beginning July 1, 2009, a new 31 school bus stop may not be established directly on a state 32 maintained road with a speed limit of 55 miles per hour or 33 greater. 34 3. To improve the safety of existing locations for school 35 bus stops for the loading and unloading of students, beginning 36 with the 2011-2012 school year, a school bus stop may not be 37 located directly on a state-maintained road with a speed limit 38 of 55 miles per hour or greater. 39 Section 2. This act shall take effect July 1, 2009.
