    1                        A bill to be entitled                      
    2         An act relating to the use of deadly force; amending
    3         s. 776.06, F.S.; defining the term “less-lethal
    4         munition” to include a dart-firing stun gun that is
    5         designed to stun, temporarily incapacitate, or cause
    6         temporary discomfort to a person; providing an
    7         effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Paragraph (a) of subsection (2) of section
   12  776.06, Florida Statutes, is amended to read:
   13         776.06 Deadly force.—
   14         (2)(a) The term “deadly force” does not include the
   15  discharge of a firearm by a law enforcement officer or
   16  correctional officer during and within the scope of his or her
   17  official duties which is loaded with a less-lethal munition. As
   18  used in this subsection, the term “less-lethal munition” means a
   19  dart-firing stun gun and any other projectile that is designed
   20  to stun, temporarily incapacitate, or cause temporary discomfort
   21  to a person without penetrating the person’s body.
   22         Section 2. This act shall take effect July 1, 2009.
