Florida Senate - 2009 CS for SB 1326 By the Committee on Regulated Industries; and Senator Fasano 580-02945-09 20091326c1 1 A bill to be entitled 2 An act relating to bingo; amending s. 849.0931, F.S.; 3 authorizing the dispensing of instant bingo tickets by 4 electronic devices; requiring that such devices be 5 capable of recording certain transaction information; 6 requiring that such devices be monitored and 7 operational only under specific circumstances; 8 providing that the devices may not be used to operate 9 in a manner other than for dispensing instant bingo 10 tickets; providing for the devices to dispense change; 11 providing an effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. Paragraph (i) is added to subsection (13) of 16 section 849.0931, Florida Statutes, to read: 17 849.0931 Bingo authorized; conditions for conduct; 18 permitted uses of proceeds; limitations.— 19 (13) 20 (i) Instant bingo tickets may be dispensed, subject to the 21 other provisions of this section, by an electronic device. An 22 electronic device used to dispense such tickets is exempt from 23 regulation under ss. 849.15 and 849.16. To be authorized, the 24 electronic device must be under the supervision and within the 25 direct line of sight of a member of the bingo organization 26 conducting the bingo game to ensure that the machine is 27 monitored and operated only by persons at least 18 years of age; 28 must be capable of being electronically deactivated to prohibit 29 use by persons younger than 18 years of age through the use of a 30 lockout device that maintains the machine’s deactivation for a 31 period of not less than 5 minutes; and must be designed to 32 prevent its use or conversion for use in any manner other than 33 the dispensing of instant bingo tickets. Authorized devices may 34 dispense change to players purchasing instant bingo tickets but 35 may not be used for paying the holders of winning tickets of any 36 kind. The device must be capable of recording each ticket 37 dispensed, the number of coins or amount of money received for 38 each ticket, and totals of each for all tickets dispensed. 39 Section 2. This act shall take effect July 1, 2009.
