8 | Be It Enacted by the Legislature of the State of Florida: |

10 | Section 1. Section 877.04, Florida Statutes, is amended to |
11 | read: |
12 | 877.04 Tattooing prohibited; penalty.-- |
13 | (1) It is unlawful for any person to tattoo the body of |
14 | any human being; except that tattooing may be performed by a |
15 | person licensed to practice medicine or dentistry under chapters |
16 | 458 and 459 or chapter 466, or by a person under his or her |
17 | general supervision as defined by the Board of Medicine. |
18 | (2) Any person who violates the provisions of this section |
19 | commits shall be guilty of a felony misdemeanor of the third |
20 | second degree, punishable as provided in s. 775.082, or s. |
21 | 775.083, or s. 775.084. |
22 | (3) No body of a minor shall be tattooed without the |
23 | written notarized consent of the parent or legal guardian. |
24 | Section 2. This act shall take effect July 1, 2009. |
