    1                        A bill to be entitled                      
    2         An act relating to a review under the Open Government
    3         Sunset Review Act regarding campaign finance reports;
    4         amending s. 106.0706, F.S., relating to an exemption
    5         from public-records requirements for user
    6         identifications and passwords held by the Department
    7         of State and information entered into the department’s
    8         electronic filing system in connection with the
    9         electronic filing of campaign finance reports;
   10         reorganizing the exemption and clarifying provisions;
   11         saving the exemption from repeal under the Open
   12         Government sunset Review Act; removing the scheduled
   13         repeal of the exemption; providing an effective date.

   15  Be It Enacted by the Legislature of the State of Florida:
   16  
   17         Section 1. Section 106.0706, Florida Statutes, is amended
   18  to read:
   19         106.0706 Electronic filing of campaign finance reports;
   20  public-records exemption confidentiality of information and
   21  draft reports.—
   22         (1) All user identifications and passwords held by the
   23  Department of State pursuant to s. 106.0705 are confidential and
   24  exempt from s. 119.07(1) and s. 24(a), Art. I of the State
   25  Constitution.
   26         (2)(a)Information entered All records, reports, and files
   27  stored in the electronic filing system for purposes of
   28  generating a report pursuant to s. 106.0705 is are exempt from
   29  s. 119.07(1) and s. 24(a), Art. I of the State Constitution.
   30         (b)Information entered in the electronic filing system is
   31  no longer exempt once the report is generated and until such
   32  time as the report has been submitted as a filed with the
   33  Division of Elections report. This section is subject to the
   34  Open Government Sunset Review Act in accordance with s. 119.15
   35  and shall stand repealed on October 2, 2009, unless reviewed and
   36  saved from repeal through reenactment by the Legislature.
   37         Section 2. This act shall take effect October 1, 2009.
