1 A bill to be entitled
2 An act relating to the receipt of gifts by candidates,
3 officers, and state employees; amending s. 112.3148,
4 F.S.; deleting a limitation on the amount of time that
5 a gift accepted on behalf of a governmental entity or
6 charitable organization may be retained; providing an
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (4) of section 112.3148, Florida
12 Statutes, is amended to read:
13 112.3148 Reporting and prohibited receipt of gifts by
14 individuals filing full or limited public disclosure of
15 financial interests and by procurement employees.—
16 (4) A reporting individual or procurement employee or any
17 other person on his or her behalf is prohibited from knowingly
18 accepting, directly or indirectly, a gift from a political
19 committee or committee of continuous existence, as defined in s.
20 106.011, or from a lobbyist who lobbies the reporting
21 individual's or procurement employee's agency, or directly or
22 indirectly on behalf of the partner, firm, employer, or
23 principal of a lobbyist, if he or she knows or reasonably
24 believes that the gift has a value in excess of $100; however,
25 such a gift may be accepted by such person on behalf of a
26 governmental entity or a charitable organization. If the gift is
27 accepted on behalf of a governmental entity or charitable
28 organization, the person receiving the gift shall not maintain
29 custody of the gift for any period of time beyond that
30 reasonably necessary to arrange for the transfer of custody and
31 ownership of the gift.
32 Section 2. This act shall take effect July 1, 2009.
