A bill to be entitled
2An act relating to Gulf County; authorizing the Department
3of Environmental Protection, notwithstanding s. 161.053,
4F.S., to issue a permit for a single-family dwelling on a
5parcel if the parcel is located in Gulf County and the
6applicant demonstrates the parcel for which the single-
7family dwelling is proposed was platted or subdivided by
8metes and bounds prior to January 1, 2009, the owner of
9the parcel for which the single-family dwelling is
10proposed does not own another parcel immediately adjacent
11to and landward of the parcel for which the dwelling is
12proposed, the proposed single-family dwelling is located
13landward of the frontal dune structure, and the proposed
14single-family dwelling will be as far landward on its
15parcel as is practicable without being located seaward of
16or on the frontal dune; providing an effective date.

18Be It Enacted by the Legislature of the State of Florida:

20     Section 1.  If, pursuant to section 161.053(2), Florida
21Statutes, the Department of Environmental Protection
22reestablishes a coastal construction control line after January
231, 2009, and if the application of section 161.053(6)(b),
24Florida Statutes, would preclude the construction of a structure
25on property the majority of which was previously not subject to
26the jurisdiction of the coastal construction control line
27program, the Department of Environmental Protection may issue a
28permit for a single-family dwelling on the parcel if the parcel
29is located in Gulf County and the applicant successfully
30demonstrates:
31     (1)  The parcel for which the single-family dwelling is
32proposed was platted or subdivided by metes and bounds prior to
33January 1, 2009;
34     (2)  The owner of the parcel for which the single-family
35dwelling is proposed does not own another parcel immediately
36adjacent to and landward of the parcel for which the dwelling is
37proposed;
38     (3)  The proposed single-family dwelling is located
39landward of the frontal dune structure; and
40     (4)  The proposed single-family dwelling will be as far
41landward on its parcel as is practicable without being located
42seaward of or on the frontal dune.
43     Section 2.  This act shall take effect upon becoming a law.
