| 2 | An act relating to Gulf County; authorizing the Department |
| 3 | of Environmental Protection, notwithstanding s. 161.053, |
| 4 | F.S., to issue a permit for a single-family dwelling on a |
| 5 | parcel if the parcel is located in Gulf County and the |
| 6 | applicant demonstrates the parcel for which the single- |
| 7 | family dwelling is proposed was platted or subdivided by |
| 8 | metes and bounds prior to January 1, 2009, the owner of |
| 9 | the parcel for which the single-family dwelling is |
| 10 | proposed does not own another parcel immediately adjacent |
| 11 | to and landward of the parcel for which the dwelling is |
| 12 | proposed, the proposed single-family dwelling is located |
| 13 | landward of the frontal dune structure, and the proposed |
| 14 | single-family dwelling will be as far landward on its |
| 15 | parcel as is practicable without being located seaward of |
| 16 | or on the frontal dune; providing an effective date. |

| 18 | Be It Enacted by the Legislature of the State of Florida: |
| 19 |
|
| 20 | Section 1. If, pursuant to section 161.053(2), Florida |
| 21 | Statutes, the Department of Environmental Protection |
| 22 | reestablishes a coastal construction control line after January |
| 23 | 1, 2009, and if the application of section 161.053(6)(b), |
| 24 | Florida Statutes, would preclude the construction of a structure |
| 25 | on property the majority of which was previously not subject to |
| 26 | the jurisdiction of the coastal construction control line |
| 27 | program, the Department of Environmental Protection may issue a |
| 28 | permit for a single-family dwelling on the parcel if the parcel |
| 29 | is located in Gulf County and the applicant successfully |
| 30 | demonstrates: |
| 31 | (1) The parcel for which the single-family dwelling is |
| 32 | proposed was platted or subdivided by metes and bounds prior to |
| 33 | January 1, 2009; |
| 34 | (2) The owner of the parcel for which the single-family |
| 35 | dwelling is proposed does not own another parcel immediately |
| 36 | adjacent to and landward of the parcel for which the dwelling is |
| 37 | proposed; |
| 38 | (3) The proposed single-family dwelling is located |
| 39 | landward of the frontal dune structure; and |
| 40 | (4) The proposed single-family dwelling will be as far |
| 41 | landward on its parcel as is practicable without being located |
| 42 | seaward of or on the frontal dune. |
| 43 | Section 2. This act shall take effect upon becoming a law. |
