Florida Senate - 2009 SB 1444 By Senator Constantine 22-01418-09 20091444__ 1 A bill to be entitled 2 An act relating to greenways and trails; amending s. 3 260.019, F.S.; deleting an obsolete provision 4 requiring that the Department of Environmental 5 Protection submit a report to the Governor and 6 Legislature; providing an effective date. 7 8 Be It Enacted by the Legislature of the State of Florida: 9 10 Section 1. Subsection (2) of section 260.019, Florida 11 Statutes, is amended to read: 12 260.019 Florida Circumnavigation Saltwater Paddling Trail.— 13 (2) The department shall establish the initial starting and 14 ending points by latitude and longitude for the trail segments 15 described in subsection (3) within 180 days after the effective 16 date of this act. Except for the Big Bend Historic Saltwater 17 Paddling Trail, segment 6, the department has the exclusive 18 authority to officially name and locate the remaining 25 trail 19 segments. The department shall name and locate the segments 20 based on logical geographical boundaries, safety to trail users, 21 ease of management, desires of local communities and user 22 groups, and other factors that assist in the overall success of 23 the trail system. The department may adjust the location of any 24 trail segment; give official recognition to specific sites along 25 the trail route; publish official trail guides and literature in 26 cooperation with other governmental and private entities; and 27 resolve conflicts that may arise between competing and 28 conflicting parties over trail issues. The Florida Greenways and 29 Trails Council may advise the department on all matters relating 30 to the paddling trail.By January 1, 2008, the department shall31prepare and submit a report setting forth the names and32locations adopted for each trail segment to the Governor, the33President of the Senate, and the Speaker of the House of34Representatives.35 Section 2. This act shall take effect July 1, 2009.
