       The Committee on Environmental Preservation and Conservation
       (Constantine) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Subsection (4) is added to section 403.7032,
    6  Florida Statutes, to read:
    7         403.7032 Recycling.—
    8         (4)The Department of Environmental Protection in
    9  cooperation with the Office of Tourism, Trade and Economic
   10  Development shall create the Recycling Business Assistance
   11  Center by July 1, 2010. The purpose of the center shall be to
   12  serve as the mechanism for coordination among state agencies and
   13  the private sector to coordinate policy and overall strategic
   14  planning for developing new markets and expanding and enhancing
   15  existing markets for recyclable materials in this state, other
   16  states, and foreign countries. The duties of the center must
   17  include, at a minimum:
   18         (a) Identifying and developing new markets and expanding
   19  and enhancing existing markets for recyclable materials;
   20         (b) Pursuing expanded end uses for recycled materials;
   21         (c) Targeting materials for concentrated market development
   22  efforts;
   23         (d) Developing proposals for new incentives for market
   24  development, particularly focusing on targeted materials;
   25         (e) Providing guidance on issues such as permitting,
   26  finance options for recycling market development, site location,
   27  research and development, grant program criteria for recycled
   28  materials markets, recycling markets education and information,
   29  and minimum content;
   30         (f) Coordinating the efforts of various governmental
   31  entities with market development responsibilities to optimize
   32  supply and demand for recyclable materials;
   33         (g) Evaluating source-reduced products as they relate to
   34  state procurement policy. The evaluation shall include, but is
   35  not limited to, the environmental and economic impact of source
   36  reduced product purchases to the state. For the purposes of this
   37  subsection, "source-reduced" means any method, process, product,
   38  or technology which significantly or substantially reduces the
   39  volume or weight of a product while providing, at a minimum,
   40  equivalent or generally similar performance and service to and
   41  for the users of such materials;
   42         (h) Providing innovative solid waste management grants,
   43  pursuant to s. 403.7095, to reduce the flow of solid waste to
   44  disposal facilities and encourage the sustainable recovery of
   45  materials from Florida’s waste stream;
   46         (i) Providing below market financing for companies that
   47  manufacture products from recycled materials or convert
   48  recyclable materials into raw materials for use in
   49  manufacturing, pursuant to the Florida Recycling Loan program as
   50  administered by the Florida First Capital Finance Corporation;
   51         (j) Maintaining a continuously updated on-line directory,
   52  listing the public and private entities that collect, transport,
   53  broker, process or remanufacture recyclable materials in
   54  Florida.
   55         (k) Providing information on the availability and benefits
   56  of using recycled materials to private entities and industries
   57  in the state; and
   58         (l) Distributing any materials prepared in implementing
   59  this subsection to the public, private entities, industries,
   60  governmental entities, or other organizations upon request.
   61         Section 2. Subsection (11) is added to section 14.2015,
   62  Florida Statutes, to read:
   63         14.2015 Office of Tourism, Trade, and Economic Development;
   64  creation; powers and duties.—
   65         (11)The Office of Tourism, Trade and Economic Development
   66  in cooperation with the Department of Environmental Protection
   67  shall create the Recycling Business Assistance Center by July 1,
   68  2010, pursuant to the requirements of subsection (4) of section
   69  403.7032. In carrying out its duties under this subsection, the
   70  Office of Tourism, Trade, and Economic Development shall consult
   71  with Enterprise Florida, Inc., and with state agency personnel
   72  appointed to serve as economic development liaisons under s.
   73  288.021.
   74         Section 3. Section 288.1185, Florida Statutes, is repealed.
   75         Section 4. This act shall take effect July 1, 2009.

   79         And the title is amended as follows:
   80         Delete everything before the enacting clause
   81  and insert:
   82         An act relating to recycling; amending ss. 403.7032, and
   83  14.2015, F.S.; directing the Department of Environmental
   84  Protection and the Office of Tourism, Trade and Economic
   85  Development to create the Recycling Business Assistance Center;
   86  providing requirements; authorizing the Office of Tourism, Trade
   87  and Economic Development to consult with Enterprise Florida,
   88  Inc., and other state agency personnel; repealing s. 288.1185,
   89  F.S.; providing an effective date.
