Florida Senate - 2009 CS for SB 1462 By the Committee on Environmental Preservation and Conservation; and Senator Constantine 592-04377-09 20091462c1 1 A bill to be entitled 2 An act relating to recycling; amending ss. 403.7032 3 and 14.2015, F.S.; directing the Department of 4 Environmental Protection and the Office of Tourism, 5 Trade, and Economic Development to create the 6 Recycling Business Assistance Center; providing 7 requirements; authorizing the Office of Tourism, 8 Trade, and Economic Development to consult with 9 Enterprise Florida, Inc., and other state agency 10 personnel; amending s. 403.707, F.S.; providing for 11 inspections of waste-to-energy facilities by the 12 Department of Environmental Protection; repealing s. 13 288.1185, F.S., relating to the Recycling Markets 14 Advisory Committee; providing an effective date. 15 16 Be It Enacted by the Legislature of the State of Florida: 17 18 Section 1. Subsection (4) is added to section 403.7032, 19 Florida Statutes, to read: 20 403.7032 Recycling.— 21 (4) The Department of Environmental Protection, in 22 cooperation with the Office of Tourism, Trade, and Economic 23 Development, shall create the Recycling Business Assistance 24 Center by July 1, 2010. The purpose of the center shall be to 25 serve as the mechanism for coordination among state agencies and 26 the private sector to coordinate policy and overall strategic 27 planning for developing new markets and expanding and enhancing 28 existing markets for recyclable materials in this state, other 29 states, and foreign countries. The duties of the center must 30 include, at a minimum: 31 (a) Identifying and developing new markets and expanding 32 and enhancing existing markets for recyclable materials; 33 (b) Pursuing expanded end uses for recycled materials; 34 (c) Targeting materials for concentrated market-development 35 efforts; 36 (d) Developing proposals for new incentives for market 37 development, particularly focusing on targeted materials; 38 (e) Providing guidance on issues such as permitting, 39 finance options for recycling market development, site location, 40 research and development, grant program criteria for recycled 41 materials markets, recycling markets education and information, 42 and minimum content; 43 (f) Coordinating the efforts of various governmental 44 entities having market-development responsibilities in order to 45 optimize supply and demand for recyclable materials; 46 (g) Evaluating source-reduced products as they relate to 47 state procurement policy. The evaluation shall include, but is 48 not limited to, the environmental and economic impact of source 49 reduced product purchases to the state. For the purposes of this 50 subsection, the term “source-reduced” means any method, process, 51 product, or technology that significantly or substantially 52 reduces the volume or weight of a product while providing, at a 53 minimum, equivalent or generally similar performance and service 54 to and for the users of such materials; 55 (h) Providing innovative solid waste management grants, 56 pursuant to s. 403.7095, to reduce the flow of solid waste to 57 disposal facilities and encourage the sustainable recovery of 58 materials from Florida’s waste stream; 59 (i) Providing below-market financing for companies that 60 manufacture products from recycled materials or convert 61 recyclable materials into raw materials for use in 62 manufacturing, pursuant to the Florida Recycling Loan Program as 63 administered by the Florida First Capital Finance Corporation; 64 (j) Maintaining a continuously updated online directory, 65 listing the public and private entities that collect, transport, 66 broker, process, or remanufacture recyclable materials in 67 Florida. 68 (k) Providing information on the availability and benefits 69 of using recycled materials to private entities and industries 70 in the state; and 71 (l) Distributing any materials prepared in implementing 72 this subsection to the public, private entities, industries, 73 governmental entities, or other organizations upon request. 74 Section 2. Subsection (11) is added to section 14.2015, 75 Florida Statutes, to read: 76 14.2015 Office of Tourism, Trade, and Economic Development; 77 creation; powers and duties.— 78 (11) The Office of Tourism, Trade, and Economic 79 Development, in cooperation with the Department of Environmental 80 Protection, shall create the Recycling Business Assistance 81 Center by July 1, 2010, pursuant to the requirements of s. 82 403.7032(4). In carrying out its duties under this subsection, 83 the Office of Tourism, Trade, and Economic Development shall 84 consult with Enterprise Florida, Inc., and with state agency 85 personnel appointed to serve as economic development liaisons 86 under s. 288.021. 87 Section 3. Present subsections (8) through (14) of section 88 403.707, Florida Statutes, are renumbered as subsections (9) 89 through (15), respectively, and a new subsection (8) is added to 90 that section, to read: 91 403.707 Permits.— 92 (8) The department must conduct at least one inspection per 93 year of each waste-to-energy facility for the purposes of 94 determining compliance with permit conditions. The facility 95 shall be given only a 24-hour notice of the inspection required 96 in this subsection. 97 Section 4. Section 288.1185, Florida Statutes, is repealed. 98 Section 5. This act shall take effect July 1, 2009.
