House Joint Resolution
2A joint resolution proposing the creation of Section 19 of
3Article VII of the State Constitution to authorize the
4Legislature to grant a partial exemption from ad valorem
5taxation and non-ad valorem assessments for homestead
6property renovated or reconstructed by certain entities.

8Be It Resolved by the Legislature of the State of Florida:

10     That the following creation of Section 19 of Article VII of
11the State Constitution is agreed to and shall be submitted to
12the electors of this state for approval or rejection at the next
13general election or at an earlier special election specifically
14authorized by law for that purpose:

FINANCE AND TAXATION
17     SECTION 19.  Partial exemption for renovation homestead
18property.--
19     (a)  By general law and subject to conditions and
20limitations specified therein, the legislature may grant a
21partial exemption from ad valorem taxation and non-ad valorem
22assessments for homestead property that has been renovated or
23reconstructed by a charitable entity in an amount equal to any
24increase in the assessed value of the homestead resulting from
25the renovation or reconstruction.
26     (b)  The duration of a tax exemption granted pursuant to
27this section shall be for a term not to exceed 30 years from the
28completion of the renovation or reconstruction and shall not be
29transferable. When the exempt status of the property changes
30during a tax year due to a sale or transfer of the property, the
31property shall be assessed and taxed at its just value and the
32procedure for the apportionment of the taxes for the year shall
33be the same as in the case of other changes in tax exemption
34status during the tax year.
35     (c)  For purposes of this section, homestead property
36eligible for the exemption provided by this section is homestead
37property consisting of a housing project performed for a
38specific person or family to renovate, reconstruct, or replace
39the home of that person or family on the same lot by a
40charitable entity organized to perform home renovations or by a
41for-profit builder using at least 75 percent volunteer labor to
42accomplish the renovation or reconstruction for the project.
43     BE IT FURTHER RESOLVED that the following statement be
44placed on the ballot:

48PROPERTY.--Proposing an amendment to the State Constitution to
49authorize the Legislature to exempt homestead property that has
50been renovated or reconstructed by a charitable entity or for-
51profit builder using predominantly volunteer labor from ad
52valorem taxation and non-ad valorem assessments in an amount
53equal to any increase in the assessed value of the homestead
54resulting from the renovation or reconstruction, limit the term
55of the exemption to 30 years, and provide for termination of the
56exemption upon sale or transfer of ownership of the property.
