       Senator Smith moved the following:
       
    1         Senate Amendment to Amendment (947302) (with title
    2  amendment)
    3  
    4         Between lines 1864 and 1865
    5  insert:
    6         Section 40. Subsection (1) of section 641.407, Florida
    7  Statutes, is amended to read:
    8         641.407 Minimum surplus.—
    9         (1) Each prepaid health clinic that is licensed before July
   10  1, 2009, shall have and maintain minimum surplus in accordance
   11  with the following schedule: On January 1, 2010 1996, $225,000
   12  $150,000 or 10 percent of total liabilities, whichever is
   13  greater; on January 1, 2011, $300,000 or 10 percent of total
   14  liabilities, whichever is greater. A prepaid health clinic that
   15  is licensed on or after July 1, 2009, shall have and maintain a
   16  surplus of $300,000 or 10 percent of total liabilities,
   17  whichever is greater. A prepaid health clinic that is licensed
   18  on or before January 1, 2004, and that has an active membership
   19  on July 1, 2009, shall have and maintain a minimum surplus of
   20  $150,000 or 10 percent of total liabilities, whichever is
   21  greater.

   25         Delete line 2101
   26  and insert:
   27         form requirements; amending s. 641.407, F.S.; revising
   28         the minimum surplus that a prepaid health clinic is
   29         required to maintain; providing a schedule for
   30         compliance; providing effective dates.
