4penalties for a home-invasion robbery in which a victim is
5an elderly person; amending s. 921.0022, F.S.; ranking the
6offense of home-invasion robbery with a victim 65 years of
7age or older on the offense severity ranking chart of the
8Criminal Punishment Code; providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:
11
12     Section 1.  This act may be cited as the "Safe at Home
13Act."
14     Section 2.  Section 812.135, Florida Statutes, is amended
15to read:
16     812.135  Home-invasion robbery.--
17     (1)  "Home-invasion robbery" means any robbery that occurs
18when the offender enters a dwelling with the intent to commit a
19robbery, and does commit a robbery of the occupants therein.
20     (2)(a)  If in the course of committing the home-invasion
21robbery the person carries a firearm or other deadly weapon, the
22person commits a felony of the first degree, punishable by
23imprisonment for a term of years not exceeding life imprisonment
24as provided in s. 775.082, s. 775.083, or s. 775.084.
25     (b)  If in the course of committing the home-invasion
26robbery the person carries a weapon, the person commits a felony
27of the first degree, punishable as provided in s. 775.082, s.
28775.083, or s. 775.084.
29     (c)  If in the course of committing the home-invasion
30robbery the person carries no firearm, deadly weapon, or other
31weapon, the person commits a felony of the first degree,
32punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
33     (d)  If a victim of the home-invasion robbery described in
34paragraph (c) is a person 65 years of age or older, the person
35commits a felony of the first degree, punishable as provided in
36s. 775.082, s. 775.083, or s. 775.084.
37     Section 3.  Paragraph (i) of subsection (3) of section
38921.0022, Florida Statutes, is amended to read:
