       Senator Baker moved the following:
       
    1         Senate Amendment to Amendment (807320) 
    2  
    3         Delete lines 82 - 95
    4  and insert:
    5         400.471 Application for license; fee.—
    6         (10)The agency may not issue an initial license, other
    7  than a change of ownership license, to a home health agency
    8  under part III of chapter 400 or this part until July 1, 2010,
    9  in any county that has at least one actively licensed home
   10  health agency and a population of persons 65 years of age or
   11  older, as indicated in the most recent population estimates
   12  published by the Executive Office of the Governor, of fewer than
   13  1,200 persons per home health agency. In such counties, for an
   14  application received by the agency before July 1, 2009, which
   15  has been deemed by the agency to be complete except for proof of
   16  accreditation, the agency may issue an initial or a change of
   17  ownership license only if the applicant applied for
   18  accreditation from an accrediting organization that is
   19  recognized by the agency before May 1, 2009.
