3     Amendment to Amendment (257873) (with title amendment)
4     Between lines 864-865, insert:
5     (12)  CONDOMINIUM WEATHERIZATION AND MITIGATION LOAN
6PROGRAM.--
7     (a)  Subject to a specific appropriation by the Legislature  
8from funds received pursuant to the American Recovery and
9Reinvestment Act of 2009, Pub. L. No. 111-5, specifically for
10the purpose of condominium weatherization, the department shall
11implement a condominium weatherization and mitigation loan
12program to assist condominium unit owners in weatherizing their
13condominium units and mitigating all such units against wind
14damage. The program shall have the following minimum
15requirements:
16     1.  The department shall contract with lenders to offer
17weatherization and hurricane mitigation loan subsidies equal to
18a competitive rate of interest on a loan balance of up to $5,000
19per condominium unit for 3 years. The interest subsidy may be
20paid in advance by the department to a lender participating in
21the program.
22     2.  The loans must be used to purchase or install
23weatherization measures and hurricane mitigation measures
24identified in paragraph (2)(e) that comply with the requirements
25of part A, Title IV of the Energy Conservation and Production
26Act, 42 U.S.C. ss. 6861 et seq., as amended by the American
27Recovery and Reinvestment Act of 2009, Pub. L. No. 111-5, as
28determined by the department.
29     3.  A participating condominium association must agree to
30purchase and install weatherization and mitigation measures for
31each unit in the condominium that lacks the weatherization and
32mitigation measures.
33     4.  To be eligible, a condominium must have been permitted
34for construction on or before March 1, 2002, be located in the
35wind-borne debris region.
36     5.  Condominiums of more than 200 units are not eligible
37for the loan program.
38     6.  The department may contract with third parties for
39auditing and related services to ensure accountability and
40program quality.
41     (b)  The loan program shall be administered on a first-
42come, first-served basis.
43     (c)  The department shall adopt rules pursuant to ss.
44120.536(1) and 120.54 to implement the loan program.
