    1                        A bill to be entitled                      
    2         An act relating to the Department of Transportation;
    3         amending s. 334.30, F.S.; prohibiting the department
    4         for a specified period from entering into an agreement
    5         with a private entity to lease an existing
    6         transportation facility; providing an effective date.
    7         
    8  Be It Enacted by the Legislature of the State of Florida:
    9         
   10         Section 1. Subsection (14) is added to section 334.30,
   11  Florida Statutes, to read:
   12         334.30 Public-private transportation facilities.—The
   13  Legislature finds and declares that there is a public need for
   14  the rapid construction of safe and efficient transportation
   15  facilities for the purpose of traveling within the state, and
   16  that it is in the public's interest to provide for the
   17  construction of additional safe, convenient, and economical
   18  transportation facilities.
   19         (14) Notwithstanding any provision of law to the contrary,
   20  during the period from July 1, 2009, until July 1, 2011, the
   21  department may not enter into any agreement with a private
   22  entity, or consortia thereof, for the leasing of an existing
   23  transportation facility as permitted under this section.
   24         Section 2. This act shall take effect July 1, 2009.
