2An act relating to criminal usury; amending s. 687.071,
3F.S.; deleting the terms "shylock" and "shylocking";
4amending s. 772.102, F.S.; conforming provisions;
5providing an effective date.

7Be It Enacted by the Legislature of the State of Florida:

9     Section 1.  Paragraphs (f) and (g) of subsection (1) of
10section 687.071, Florida Statutes, are amended to read:
11     687.071  Criminal usury, loan sharking; shylocking.--
12     (1)  DEFINITIONS.--The following words and phrases, as used
13in this section, shall have the following meanings:
14     (f)  "Loan shark" or "shylock" means any person as defined
15herein who lends money unlawfully under subsection (2),
16subsection (3), or subsection (4).
17     (g)  "Loan sharking" or "shylocking" means the act of any
18person as defined herein lending money unlawfully under
19subsection (2), subsection (3), or subsection (4).
20     Section 2.  Paragraph (a) of subsection (2) of section
21772.102, Florida Statutes, is amended to read:
22     772.102  Definitions.--As used in this chapter, the term:
23     (2)  "Unlawful debt" means any money or other thing of
24value constituting principal or interest of a debt that is
25legally unenforceable in this state in whole or in part because
26the debt was incurred or contracted:
27     (a)  In violation of any one of the following provisions of
28law:
29     1.  Section 550.235, s. 550.3551, or s. 550.3605, relating
30to dogracing and horseracing.
31     2.  Chapter 550, relating to jai alai frontons.
32     3.  Section 687.071, entitled relating to "Criminal usury",
33loan sharking, and shylocking.
34     4.  Section 849.09, s. 849.14, s. 849.15, s. 849.23, or s.
35849.25, relating to gambling.
36     Section 3.  This act shall take effect October 1, 2009.
