6 320.08056, Florida Statutes, is amended, paragraphs (qqq)
7 through (yyy) are added to that subsection, and subsections (13)
8 and (14) are added to that section, to read:
9 320.08056 Specialty license plates.—
10 (4) The following license plate annual use fees shall be
11 collected for the appropriate specialty license plates:
12 (cc) Choose Life license plate, $25 $20.
13 (qqq) Autism license plate, $25.
14 (rrr) Let’s Go Surfing license plate, $25.
15 (sss) Florida Horse Park license plate, $25.
16 (ttt) St. Johns River license plate, $25.
17 (uuu) Endless Summer license plate, $25.
18 (vvv) Catch Me, Release Me license plate, $25.
19 (www) Fraternal Order of Police license plate, $25.
20 (xxx) Go Green Florida license plate, $25.
21 (yyy) Florida Biodiversity Foundation license plate, $25.
22 (zzz) Children First license plate, $25.
23 (aaaa) Toomey Foundation for the Natural Sciences license
24 plate, $25.
25 (bbbb) Trinity license plate, $25.
26 (13) Effective July 1, 2011, in addition to the
27 requirements of subsections (10) and (11) and notwithstanding
28 any specific authority provided in s. 320.08058, an organization
29 or entity receiving annual use fee revenue from the sale of a
30 specialty license plate may use no more than a total of 10
31 percent of the revenues for administrative, marketing, and
32 promotion costs, including annual audit and compliance affidavit
33 costs.
34 (14) Notwithstanding any other provision of this chapter,
35 no annual use fee revenue derived from the sale of a specialty
36 license plate, or the interest thereon, shall be expended on
37 projects or programs outside this state.
38 Section 2. Subsection (29), paragraph (b) of subsection
39 (32), and subsection (35) of section 320.08058, Florida
40 Statutes, are amended, and subsections (69) through (77) are
41 added to that section, to read:
42 320.08058 Specialty license plates.—
43 (29) CHOOSE LIFE LICENSE PLATES.—
44 (a) The department shall develop a Choose Life license
45 plate as provided in this section. The word “Florida” must
46 appear at the bottom of the plate, and the words “Choose Life”
47 must appear at the top of the plate.
48 (b) The annual use fees shall be distributed quarterly to
49 Choose Life, Inc., a s. 501(c)(3) nonprofit corporation, with a
50 list of annually to each county in the ratio that the annual use
51 fees collected by each county bears to the total fees collected
52 for the plates within the state.
53 (c) Up to 10 percent of the fees may be used for
54 administrative costs directly associated with the operations of
55 Choose Life, Inc., and activities by Choose Life, Inc., to
56 promote adoption and to market the license plate in this state.
57 Choose Life, Inc., shall administer distribution of the
58 remaining Each county shall distribute the funds to
59 nongovernmental, not-for-profit agencies within the county,
60 which agencies’ services primarily consist of are limited to
61 counseling and meeting the physical needs of pregnant women who
62 are considering committed to placing their children for
63 adoption.
64 1. Funds may not be distributed to any agency that is
65 involved or associated with abortion activities, including
66 counseling for or referrals to abortion clinics, providing
67 medical abortion-related procedures, or proabortion advertising,
68 and funds may not be distributed to any agency that charges
69 women for services received.
70 2. Choose Life license plate funds generated in counties
71 that do not have a qualified service provider shall be
72 distributed by Choose Life, Inc., to qualified service providers
73 in other counties. For purposes of this subparagraph, the term
74 “qualified service provider” means an entity that provides
75 medically accurate materials, with reference sources for any and
76 all statements of a medical nature. Sources may include, but are
77 not limited to, entities such as the Centers for Disease
78 Control, the American College of Obstetricians and
79 Gynecologists, and peer-reviewed health science journals, such
80 as the Journal of the American Medical Association.
81 3. Funds shall not be removed from a county with active
82 qualified service providers for distribution to service
83 providers in other counties unless year-end unused fund balances
84 exceed 20 percent of the county’s annual Choose Life license
85 plate revenues for 3 consecutive years. If year-end fund
86 balances exceed 20 percent of a county’s annual revenues for 3
87 consecutive years, such balance may be distributed by Choose
88 Life, Inc., to qualified service providers in other counties.
89 4.1. Agencies that receive the funds must use at least 70
90 percent of the funds to provide for the material needs of
91 pregnant women who are considering committed to placing their
92 children for adoption, including clothing, housing, medical
93 care, food, utilities, and transportation. Such funds may also
94 be expended on infants awaiting placement with adoptive parents.
95 5.2. A maximum of 30 percent of the remaining funds may be
96 used for adoption, counseling, training, or advertising, but may
97 not be used for administrative expenses, legal expenses, or
98 capital expenditures.
99 6.3. Each service provider agency that receives such funds
100 must submit an annual attestation to Choose Life, Inc., which
101 shall, upon request, make copies available to a state agency
102 charged with auditing the county. Any unused funds that exceed
103 10 percent of the funds received by an agency during its fiscal
104 year must be returned to the county, which shall distribute them
105 to other qualified agencies.
106 7. Choose Life license plate use fees generated in this
107 state may only be spent on activities within this state.
108 (d)1. Within 90 days after the effective date of this
109 paragraph, county commissions that have never distributed Choose
110 Life funds shall forward such funds to Choose Life, Inc., for
111 distribution.
112 2. Within 180 days after the effective date of this
113 paragraph, county commissions that have been distributing Choose
114 Life funds shall forward fund balances to Choose Life, Inc., for
115 distribution.
116 (32) UNITED WE STAND LICENSE PLATES.—
117 (b) The department shall retain all revenues from the sale
118 of such plates until all startup costs for developing and
119 issuing the plates have been recovered. Thereafter,
120 notwithstanding s. 332.14, 100 percent of the annual use fee
121 shall be distributed to the Department of Transportation SAFE
122 Council for the development and implementation of programs to
123 fund a grant program to enhance security at airports throughout
124 the state, pursuant to s. 332.14. Up to 10 percent of the annual
125 use fee revenue may be used for administration, promotion, and
126 marketing of the plate, including annual audit and compliance
127 affidavit costs.
128 (35) FLORIDA GOLF LICENSE PLATES.—
129 (a) The Department of Highway Safety and Motor Vehicles
130 shall develop a Florida Golf license plate as provided in this
131 section. The word “Florida” must appear at the bottom of the
132 plate. The Dade Amateur Golf Association, following consultation
133 with the PGA TOUR, the Florida Sports Foundation, the LPGA, and
134 the PGA of America may submit a revised sample plate for
135 consideration by the department.
136 (b) The department shall distribute the Florida Golf
137 license plate annual use fee to the Dade Amateur Golf
138 Association, a s. 501(c)(3) organization Florida Sports
139 Foundation, a direct-support organization of the Office of
140 Tourism, Trade, and Economic Development. The license plate
141 annual use fees are to be annually allocated as follows:
142 1. Up to 10 5 percent of the proceeds from the annual use
143 fees may be used by the Dade Amateur Golf Association Florida
144 Sports Foundation for the administration of the Florida Junior
145 Youth Golf Program.
146 2. The Dade Amateur Golf Association shall receive the
147 first $80,000 in proceeds from the annual use fees for the
148 operation of youth golf programs in Miami-Dade County.
149 Thereafter, 15 percent of the proceeds from the annual use fees
150 shall be provided to the Dade Amateur Golf Association for the
151 operation of youth golf programs in Miami-Dade County.
152 3. The remaining proceeds from the annual use fees shall be
153 available for grants to nonprofit organizations to operate youth
154 golf programs and for marketing the Florida Golf license plates.
155 All grant recipients, including the Dade Amateur Golf
156 Association, shall be required to provide to the Dade Amateur
157 Golf Association Florida Sports Foundation an annual program and
158 financial report regarding the use of grant funds. Such reports
159 shall be made available to the public.
160 (c) The Dade Amateur Golf Association shall Florida Sports
161 Foundation may establish a Florida Junior Golf Council Youth
162 Golf Program. The Florida Junior Golf Council Youth Golf Program
163 shall assist organizations for the benefit of youth, introduce
164 young people to golf, instruct young people in golf, teach the
165 values of golf, and stress life skills, fair play, courtesy, and
166 self-discipline.
167 (d) The Dade Amateur Golf Association Florida Sports
168 Foundation shall establish a seven-member Florida Junior Golf
169 Council committee to offer advice regarding the distribution of
170 the annual use fees for grants to nonprofit organizations. The
171 council advisory committee shall consist of one member from a
172 group serving youth, one member from a group serving disabled
173 youth, and five members at large.
174 (69) AUTISM LICENSE PLATES.—
175 (a) The department shall develop an Autism license plate as
176 provided in this section. Autism license plates must bear the
177 colors and design approved by the department. The word “Florida”
178 must appear at the top of the plate, and the words “Support
179 Autism Programs” must appear at the bottom of the plate.
180 (b) The proceeds from the license plate annual use fee
181 shall be distributed to Achievement and Rehabilitation Centers,
182 Inc., to fund service programs for autism and related
183 disabilities throughout the state and to operate and establish
184 programs to support individuals with autism and related
185 disabilities through direct services, evaluation, training, and
186 awareness. Achievement and Rehabilitation Centers, Inc., shall
187 establish an Autism Services Grant Council that shall provide
188 grants from available Autism license plate proceeds to nonprofit
189 organizations for direct services and programs for individuals
190 with autism and related disabilities and their families.
191 Consideration for participation in such services and programs
192 shall be given to applicants who are children or adults with
193 autism and related disabilities and their families and shall
194 include those who are on the Agency for Persons with
195 Disabilities waiting lists for services. Achievement and
196 Rehabilitation Centers, Inc., shall also establish an Autism
197 License Plate Fund. Moneys in the fund shall be used by the
198 grant council as provided in this paragraph. All funds received
199 under this subsection must be used in this state.
200 (c) Achievement and Rehabilitation Centers, Inc., may
201 retain all proceeds from the annual use fee up to $85,000 until
202 all documented startup costs for developing and establishing the
203 plate have been recovered. Thereafter, the proceeds from the
204 annual use fee shall be used as follows:
205 1. Up to 10 percent of the proceeds from the annual use fee
206 may be used for the administration of the Autism License Plate
207 Fund, the Autism Services Grant Council, and related matters.
208 2. Funds may be used as necessary for annual audit or
209 compliance affidavit costs.
210 3. Thirty-five percent of the proceeds from the annual use
211 fee shall be used to establish and operate programs to support
212 individuals with autism and related disabilities and their
213 families through direct services, evaluation, training, and
214 awareness in the state.
215 4. The Center for Autism and Related Disabilities at the
216 University of Miami shall receive 15 percent of the proceeds
217 from the annual use fee for distribution, as determined
218 appropriate by the director of that center, to the seven
219 regional autism centers created under s. 1004.55. The regional
220 centers shall use the proceeds to support the services they
221 provide.
222 5. The remaining proceeds from the annual use fee shall be
223 available to the Autism Services Grant Council for grants to
224 nonprofit organizations to operate direct services programs for
225 individuals with autism and related disabilities and their
226 families and for marketing the Autism license plate. All grant
227 recipients, including Achievement and Rehabilitation Centers,
228 Inc., and the Center for Autism and Related Disabilities, shall
229 be required to provide to the Autism Services Grant Council an
230 annual program and financial report regarding the use of grant
231 funds. Such reports shall be made available to the public.
232 (d) Notwithstanding any provision of law to the contrary,
233 the first $10,000 in proceeds generated from voluntary
234 contributions to the Autism License Plate Fund authorized in ss.
235 320.02 and 322.08 shall be retained by the department to offset
236 the department’s implementation costs.
237 (70) LET’S GO SURFING LICENSE PLATES.—
238 (a) The department shall develop a Let’s Go Surfing license
239 plate as provided in this section. Let’s Go Surfing license
240 plates must bear the colors and design approved by the
241 department. The word “Florida” must appear at the top of the
242 plate, and the words “Let’s Go Surfing” must appear at the
243 bottom of the plate.
244 (b) The license plate annual use fees shall be distributed
245 to East Coast Surfing Hall of Fame and Museum, Inc., to fund
246 activities, programs, and projects to promote Florida’s surfing
247 related tourism, preserve Florida’s surfing history and
248 heritage, preserve Florida’s surf and shores, and honor
249 lifeguards who patrol Florida’s surf and shores to protect
250 beachgoers, surfers, and others. East Coast Surfing Hall of Fame
251 and Museum, Inc., may retain all revenue from the annual use
252 fees until all startup costs for developing and establishing the
253 plate have been recovered. Thereafter, up to 10 percent of the
254 annual use fee revenue may be used for administration,
255 promotion, and marketing of the plate, including annual audit
256 and compliance affidavit costs.
257 (71) FLORIDA HORSE PARK LICENSE PLATES.—
258 (a) The department shall develop a Florida Horse Park
259 license plate as provided in this section. Florida Horse Park
260 license plates must bear the colors and design approved by the
261 department. The word “Florida” must appear at the top of the
262 plate, and the words “Discover Florida’s Horses” must appear at
263 the bottom of the plate.
264 (b) The annual use fees shall be distributed to the Florida
265 Agriculture Center and Horse Park Authority created by s.
266 570.952, which shall retain all proceeds until all startup costs
267 for developing and establishing the plate have been recovered.
268 Thereafter, the proceeds shall be used as follows:
269 1. A maximum of 5 percent of the proceeds from the annual
270 use fees may be used for the administration of the Florida Horse
271 Park license plate program.
272 2. A maximum of 5 percent of the proceeds may be used to
273 promote and market the license plate.
274 3. The remaining proceeds shall be used by the authority to
275 promote the Florida Agriculture Center and Horse Park located in
276 Marion County; to support continued development of the park,
277 including the construction of additional educational facilities,
278 barns, and other structures; to provide improvements to the
279 existing infrastructure at the park; and to provide for
280 operational expenses of the Florida Agriculture Center and Horse
281 Park.
282 (72) ST. JOHNS RIVER LICENSE PLATES.—
283 (a) The department shall develop a St. Johns River license
284 plate as provided in this section. St. Johns River license
285 plates must bear the colors and design approved by the
286 department. The word “Florida” must appear at the top of the
287 plate, and the words “St. Johns River” must appear at the bottom
288 of the plate.
289 (b) The requirements of s. 320.08053 must be met prior to
290 the issuance of the plate. Thereafter, the license plate annual
291 use fees shall be distributed to the St. Johns River Alliance,
292 Inc., a s. 501(c)(3) nonprofit organization, which shall
293 administer the fees as follows:
294 1. The St. Johns River Alliance, Inc., shall retain the
295 first $60,000 of the annual use fees as direct reimbursement for
296 administrative costs, startup costs, and costs incurred in the
297 development and approval process. Thereafter, up to 10 percent
298 of the annual use fee revenue may be used for administrative
299 costs directly associated with education programs, conservation,
300 research, and grant administration of the organization and for
301 promotion and marketing of the specialty license plate.
302 2. At least 30 percent of the fees shall be available for
303 competitive grants for targeted community-based or county-based
304 research or projects for which state funding is limited or not
305 currently available. The remaining 50 percent shall be directed
306 toward community outreach and access programs. The competitive
307 grants shall be administered and approved by the board of
308 directors of the St. Johns River Alliance, Inc. A grant advisory
309 committee shall be composed of six members chosen by the St.
310 Johns River Alliance board members.
311 3. Any remaining funds shall be distributed with the
312 approval of and accountability to the board of directors of the
313 St. Johns River Alliance, Inc., and shall be used to support
314 activities contributing to education, outreach, and springs
315 conservation.
316 (73) ENDLESS SUMMER LICENSE PLATES.—
317 (a) The department shall develop an Endless Summer license
318 plate as provided in this section. Endless Summer license plates
319 must bear the colors and design approved by the department. The
320 word “Florida” must appear at the top of the plate, and the
321 words “Endless Summer” must appear at the bottom of the plate.
322 (b) The license plate annual use fees shall be distributed
323 to Surfing’s Evolution & Preservation Corporation to fund its
324 activities, programs, and projects aimed at preserving the sport
325 of surfing. Surfing’s Evolution & Preservation Corporation may
326 retain all revenue from the annual use fees until all startup
327 costs for developing and establishing the plate have been
328 recovered. Thereafter, up to 10 percent of the annual use fee
329 revenue may be used for promotion and marketing of the specialty
330 license plate and administrative costs directly associated with
331 the corporation’s programs and the specialty license plate.
332 Surfing’s Evolution & Preservation Corporation shall use the
333 remaining funds as follows:
334 1. To fund the proposed Surfing’s Evolution & Preservation
335 Experience project.
336 2. To provide funds for the provision of lifeguards or the
337 building of artificial reefs.
338 3. To provide funds to organizations that house the history
339 and artifacts of surfing or promote the sport through exhibits,
340 lectures, and events.
341 4. To support programs and events of other organizations
342 that support beaches and oceans and promote education on beach
343 safety, coastal pollution, and beach ecology.
344 (74) CATCH ME, RELEASE ME LICENSE PLATES.—
345 (a) The department shall develop a Catch Me, Release Me
346 license plate as provided in this section. Catch Me, Release Me
347 license plates must bear the colors and design approved by the
348 department. The word “Florida” must appear at the top of the
349 plate, and the words “Catch Me, Release Me” must appear at the
350 bottom of the plate.
351 (b) The license plate annual use fees shall be distributed
352 to the Guy Harvey Ocean Foundation, Inc., to fund marine-related
353 scientific research, including research of free-ranging pelagic
354 marine species that inhabit, use, or migrate through Florida
355 waters; conservation initiatives; and education and public
356 outreach programs targeting school-aged children in the state.
357 The Guy Harvey Ocean Foundation, Inc., may retain all revenue up
358 to $60,000 from the annual use fees until all startup costs for
359 developing and establishing the plate have been recovered.
360 Thereafter, up to 10 percent of the annual use fee revenue may
361 be used for administrative costs directly associated with the
362 operations of the Guy Harvey Ocean Foundation, Inc., and up to
363 10 percent may be used for promotion and marketing of the
364 specialty license plate.
365 (75) FRATERNAL ORDER OF POLICE LICENSE PLATES.—
366 (a) The department shall develop a Fraternal Order of
367 Police license plate as provided in this section. Fraternal
368 Order of Police license plates must bear the colors and design
369 approved by the department. The word “Florida” must appear at
370 the top of the plate, and the words “Fraternal Order of Police”
371 must appear at the bottom of the plate.
372 (b) In order to purchase the Fraternal Order of Police
373 license plate, a person must submit a certified letter from the
374 Florida State Lodge of the Fraternal Order of Police showing
375 that he or she qualifies for the use of the Fraternal Order of
376 Police law enforcement emblem by being a member in good
377 standing.
378 (c) The license plate annual use fees shall be distributed
379 to the Florida State Lodge Fraternal Order of Police Memorial
380 Foundation to fund its activities, programs, and projects aimed
381 at preserving, maintaining, and expanding the Florida Fraternal
382 Order of Police Law Enforcement Memorial. The Florida State
383 Lodge of the Fraternal Order of Police may retain all revenue
384 from the annual use fees until all startup costs for developing
385 and establishing the plate have been recovered. Thereafter, up
386 to 10 percent of the annual use fee revenue may be used for
387 promotion and marketing of the specialty license plate and
388 administrative costs directly associated with memorial programs
389 and the specialty license plate. The Florida State Lodge
390 Fraternal Order of Police Memorial Foundation shall use the
391 remaining funds as follows:
392 1. To fund the Florida State Fraternal Order of Police Law
393 Enforcement Memorial projects.
394 2. To provide funds for the expansion, maintenance, and
395 support of the Florida State Lodge Fraternal Order of Police
396 Memorial Foundation.
397 3. To provide funds to organizations that help support the
398 families of law enforcement officers who have died in the line
399 of duty.
400 4. To support programs and events that support the Florida
401 Fraternal Order of Police Law Enforcement Memorial.
402 (76) GO GREEN FLORIDA LICENSE PLATES.—
403 (a) The department shall develop a Go Green Florida license
404 plate as provided in this section. Go Green Florida license
405 plates must bear the colors and design approved by the
406 department. The word “Florida” must appear at the top of the
407 plate, the words “Go Green” must appear on the bottom of the
408 plate, and the “Go Green Florida” emblem or logo must appear on
409 the plate.
410 (b) The requirements of s. 320.08053 must be met prior to
411 the issuance of the plate. The annual use fees shall be
412 distributed to the Coalition for Renewable Energy Solutions,
413 Inc. After reimbursement for documented costs expended to
414 establish the plate, the proceeds of the annual use fees shall
415 be used in the following manner:
416 1. Up to 10 percent may be used by the Coalition for
417 Renewable Energy Solutions, Inc., for administrative, promotion,
418 and marketing costs.
419 2. The remainder shall be used to fund the Solar Energy
420 System Incentives Program pursuant to s. 377.806, as directed by
421 the Florida Energy and Climate Commission. These funds may be
422 remitted directly from the department to the Solar Energy System
423 Incentives Program on a quarterly basis based on a calculation
424 of fees collected.
425 (c) The Coalition for Renewable Energy Solutions, Inc.,
426 shall submit financial records and statements to the Office of
427 the Auditor General for all expenditures related to the Go Green
428 Florida program no later than 60 days after the end of each
429 fiscal year.
430 (d) The “Go Green Florida” emblem or logo may be authorized
431 for use by the department in recognition of energy-efficient
432 vehicle usage and practices. The display of the decal for
433 energy-efficient practices may not be considered a substitute
434 for a legal license tag.
435 (77) FLORIDA BIODIVERSITY FOUNDATION LICENSE PLATES.—
436 (a) The department shall develop a Florida Biodiversity
437 Foundation license plate as provided in this section. Florida
438 Biodiversity Foundation license plates must bear the colors and
439 design approved by the department. The word “Florida” must
440 appear at the top of the plate, and the words “Save Wild
441 Florida” must appear at the bottom of the plate.
442 (b) The annual use fees shall be distributed to the Florida
443 Biodiversity Foundation, Inc., which shall retain 50 percent of
444 the proceeds until the startup costs to develop and establish
445 the plates have been recovered. Thereafter, the proceeds shall
446 be used as follows:
447 1. A maximum of 25 percent of the proceeds may be used to
448 fund the administrative, promotion, and marketing costs of the
449 license plate program and the foundation.
450 2. The remaining fees shall be used by the foundation to
451 fund research, education, and scientific study of the diversity
452 of animals and plants and to aid in the preservation, study,
453 conservation, and recovery of imperiled organisms.
454 (78) CHILDREN FIRST LICENSE PLATES.—
455 (a) The department shall develop a Children First license
456 plate as provided in this section. The plate must bear the
457 colors and design approved by the department. The word “Florida”
458 must appear at the top of the plate and the words “Children
459 First” must appear at the bottom of the plate.
460 (b) The annual use fees shall be distributed to Children
461 First Florida, Inc., which shall retain all proceeds until the
462 startup costs to develop and establish the plates have been
463 recovered. Thereafter, the proceeds shall be used as follows:
464 1. A maximum of 15 percent of the proceeds may be used to
465 administer the license plate program and for direct
466 administrative costs associated with the operations of Children
467 First Florida, Inc.
468 2. A maximum of 10 percent of the proceeds may be used to
469 promote and market the license plates.
470 3. The remaining fees shall be used by Children First
471 Florida, Inc., to fund public schools in this state, including
472 teacher salaries.
473 (79) TOOMEY FOUNDATION FOR THE NATURAL SCIENCES LICENSE
474 PLATES.—
475 (a) The department shall develop a Toomey Foundation for
476 the Natural Sciences license plate as provided in this section.
477 The plate must bear the colors and design approved by the
478 department. The word “Florida” must appear at the top of the
479 plate, and the words “Preserving the Past” must appear at the
480 bottom of the plate.
481 (b) The annual use fees shall be distributed to the Toomey
482 Foundation for the Natural Sciences, Inc., which shall retain 50
483 percent of the proceeds until the startup costs to develop and
484 establish the plates have been recovered. Thereafter, the
485 proceeds shall be used as follows:
486 1. A maximum of 25 percent of the proceeds may be used to
487 fund the administrative, promotion, and marketing costs of the
488 license plate program and the foundation.
489 2. The remaining fees shall be used by the foundation to
490 acquire, manage, and preserve properties that are of scientific
491 importance to paleontologists, archeologists, or geologists for
492 the purposes of research and education, and to promote and
493 protect the unique natural sciences of this state.
494 (80) TRINITY LICENSE PLATES.—
495 (a) The department shall develop a Trinity license plate as
496 provided in this section. The plate must bear the colors and
497 design approved by the department. The word “Florida” must
498 appear at the top of the plate and the words “Sunshine State”
499 must appear at the bottom of the plate.
500 (b) The annual use fees shall be distributed to the Toomey
501 Foundation for the Natural Sciences, Inc., which shall retain 50
502 percent of the proceeds until the startup costs to develop and
503 establish the plates have been recovered. Thereafter, the
504 proceeds shall be used as follows:
505 1. A maximum of 25 percent of the proceeds may be used to
506 fund the administrative, promotion, and marketing costs of the
507 license plate program and the foundation.
508 2. The remaining fees shall be used by the foundation to
509 support educational, research, and scientific activities in this
510 state, including the distribution of funds to qualified entities
511 in furtherance of the stated purposes of the foundation.
512 Section 3. Paragraphs (h) and (i) are added to subsection
513 (15) of section 320.02, Florida Statutes, to read:
514 320.02 Registration required; application for registration;
515 forms.—

517 (h) The application form for motor vehicle registration and
518 renewal of registration must include language permitting a
519 voluntary contribution of $5 to the Autism License Plate Fund
520 administered by Achievement and Rehabilitation Centers, Inc.
521 Except as provided in s. 320.08058(69)(d), such contributions
522 must be distributed by the department each month to the Autism
523 License Plate Fund administered by Achievement and
524 Rehabilitation Centers, Inc., to be used as provided in s.
525 320.08058(69).
526 (i) The application form for motor vehicle registration and
527 renewal of registration must include language permitting a
528 voluntary contribution of $1 to Ronald McDonald Houses of
529 Florida. Such contributions must be distributed by the
530 department each month to Ronald McDonald House Charities Tampa
531 Bay, Inc., a not-for-profit organization.

533 For the purpose of applying the service charge provided in s.
534 215.20, contributions received under this subsection are not
535 income of a revenue nature.
536 Section 4. Paragraph (b) of subsection (1) and subsection
537 (3) of section 320.06, Florida Statutes, as amended by section 2
538 of chapter 2009-14, Laws of Florida, are amended to read:
539 320.06 Registration certificates, license plates, and
540 validation stickers generally.—
541 (1)
542 (b) Registration license plates bearing a graphic symbol
543 and the alphanumeric system of identification shall be issued
544 for a 10-year 6-year period. At the end of that 10-year 6-year
545 period, upon renewal, the plate shall be replaced. The
546 department shall stagger the implementation of the 10-year 6
547 year license plate replacement cycle. The fee for such
548 replacement is $20 $12, $2 of which shall be paid each year
549 before the plate is replaced, to be credited towards the next
550 $20 $12 replacement fee. The fees shall be deposited into the
551 Highway Safety Operating Trust Fund. A credit or refund shall
552 not be given for any prior years’ payments of such prorated
553 replacement fee if the plate is replaced or surrendered before
554 the end of the 10-year 6-year period, except that a credit may
555 be given when a registrant is required by the department to
556 replace a license plate under s. 320.08056(8)(a). With each
557 license plate, there shall be issued a validation sticker
558 showing the owner’s birth month, license plate number, and the
559 year of expiration or the appropriate renewal period if the
560 owner is not a natural person. The validation sticker shall be
561 placed on the upper right corner of the license plate. Such
562 license plate and validation sticker shall be issued based on
563 the applicant’s appropriate renewal period. The registration
564 period is a period of 12 months, the extended registration
565 period is a period of 24 months, and all expirations shall occur
566 based on the applicant’s appropriate registration period. A
567 vehicle with an apportioned registration shall be issued an
568 annual license plate and a cab card that denote the declared
569 gross vehicle weight for each apportioned jurisdiction in which
570 the vehicle is authorized to operate.
571 (3)(a) Registration license plates shall be of metal
572 specially treated with a retroreflective material, as specified
573 by the department. The registration license plate is designed to
574 increase nighttime visibility and legibility and shall be at
575 least 6 inches wide and not less than 12 inches in length,
576 unless a plate with reduced dimensions is deemed necessary by
577 the department to accommodate motorcycles, mopeds, or similar
578 smaller vehicles. Validation stickers shall be treated with a
579 retroreflective material, shall be of such size as specified by
580 the department, and shall adhere to the license plate. The
581 registration license plate shall be imprinted with a combination
582 of bold letters and numerals or numerals, not to exceed seven
583 digits, to identify the registration license plate number. The
584 license plate shall also be imprinted with the word “Florida” at
585 the top and the name of the county in which it is sold, the
586 state motto, or the words “Sunshine State” at the bottom.
587 Apportioned license plates shall have the word “Apportioned” at
588 the bottom and license plates issued for vehicles taxed under s.
589 320.08(3)(d), (4)(m) or (n), (5)(b) or (c), or (14) shall have
590 the word “Restricted” at the bottom. License plates issued for
591 vehicles taxed under s. 320.08(12) must be imprinted with the
592 word “Florida” at the top and the word “Dealer” at the bottom.
593 Manufacturer license plates issued for vehicles taxed under s.
594 320.08(12) must be imprinted with the word “Florida” at the top
595 and the word “Manufacturer” at the bottom. License plates issued
596 for vehicles taxed under s. 320.08(5)(d) or (e) must be
597 imprinted with the word “Wrecker” at the bottom. Any county may,
598 upon majority vote of the county commission, elect to have the
599 county name removed from the license plates sold in that county.
600 The state motto or the words “Sunshine State” shall be printed
601 in lieu thereof. A license plate issued for a vehicle taxed
602 under s. 320.08(6) may not be assigned a registration license
603 number, or be issued with any other distinctive character or
604 designation, which that distinguishes the motor vehicle as a
605 for-hire motor vehicle.
606 (b) An additional fee of 50 cents shall be collected and
607 deposited into the Highway Safety Operating Trust Fund on each
608 motor vehicle registration or motor vehicle renewal registration
609 issued in this state in order that material costs are paid for
610 all license plates and validation stickers be fully treated with
611 retroreflective material.
612 Section 5. Section 320.0706, Florida Statutes, is amended
613 to read:
614 320.0706 Display of license plates on trucks.—The owner of
615 any commercial truck of gross vehicle weight of 26,001 pounds or
616 more shall display the registration license plate on both the
617 front and rear of the truck in conformance with all the
618 requirements of s. 316.605 that do not conflict with this
619 section. The owner of a dump truck may place the rear license
620 plate on the gate no higher than 60 inches to allow for better
621 visibility. However, the owner of a truck tractor shall be
622 required to display the registration license plate only on the
623 front of such vehicle. The owner of any wrecker issued a regular
624 wrecker license plate shall display the license plate only on
625 the front of the vehicle. The owner of any wrecker issued gross
626 vehicle weight wrecker license plates shall display the license
627 plates on both the front and rear of the vehicle in conformance
628 with the requirements of s. 316.605 that do not conflict with
629 this section. A violation of this section is a noncriminal
630 traffic infraction, punishable as a moving violation as provided
631 in chapter 318.
632 Section 6. Subsection (6) of section 322.08, Florida
633 Statutes, is amended to read:
634 322.08 Application for license.—
635 (6) The application form for a driver’s license or
636 duplicate thereof shall include language permitting the
637 following:
638 (a) A voluntary contribution of $1 per applicant, which
639 contribution shall be deposited into the Health Care Trust Fund
640 for organ and tissue donor education and for maintaining the
641 organ and tissue donor registry.
642 (b) A voluntary contribution of $1 per applicant, which
643 contribution shall be distributed to the Florida Council of the
644 Blind.
645 (c) A voluntary contribution of $2 per applicant, which
646 shall be distributed to the Hearing Research Institute,
647 Incorporated.
648 (d) A voluntary contribution of $1 per applicant, which
649 shall be distributed to the Juvenile Diabetes Foundation
650 International.
651 (e) A voluntary contribution of $1 per applicant, which
652 shall be distributed to the Children’s Hearing Help Fund.
653 (f) A voluntary contribution of $1 per applicant, which
654 shall be distributed to Family First, a nonprofit organization.
655 (g) A voluntary contribution of $5 per applicant, which,
656 except as provided in s. 320.08058(69)(d), shall be distributed
657 to the Autism License Plate Fund administered by Achievement and
658 Rehabilitation Centers, Inc., to be used as provided in s.
659 320.08058(69).

661 A statement providing an explanation of the purpose of the trust
662 funds shall also be included. For the purpose of applying the
663 service charge provided in s. 215.20, contributions received
664 under paragraphs (b), (c), (d), (e), and (f), and (g) and under
665 s. 322.18(9)(a) are not income of a revenue nature.
666 Section 7. This act shall take effect July 1, 2009.
