4     Between lines 63 and 64, insert:
5     Section 2.  Paragraph (a) of subsection (3) of section
61008.34, Florida Statutes, is amended to read:
7     1008.34  School grading system; school report cards;
8district grade.--
9     (3)  DESIGNATION OF SCHOOL GRADES.--
10     (a)  Each school that has students who are tested and
11included in the school grading system shall receive a school
12grade, except as follows:
13     1.  A school shall not receive a school grade if the number
14of its students tested and included in the school grading system
15is less than the minimum sample size necessary, based on
16accepted professional practice, for statistical reliability and
17prevention of the unlawful release of personally identifiable
18student data under s. 1002.22 or 20 U.S.C. s. 1232g.
19     2.  A district An alternative school, or a charter school,
20that provides dropout prevention and academic intervention
21services pursuant to s. 1003.53 may choose to receive a school
22grade under this section or a school improvement rating under s.
231008.341. For a charter school under this subparagraph, the
24decision to receive a school grade is a decision made by the
25charter school governing board.
26     3.  A school that serves any combination of students in
27kindergarten through grade 3 which does not receive a school
28grade because its students are not tested and included in the
29school grading system shall receive the school grade designation
30of a K-3 feeder pattern school identified by the Department of
31Education and verified by the school district. A school feeder
32pattern exists if at least 60 percent of the students in the
33school serving a combination of students in kindergarten through
34grade 3 are scheduled to be assigned to the graded school.
35     Section 3.  Subsection (2) of section 1008.341, Florida
36Statutes, is amended to read:
37     1008.341  School improvement rating for alternative
38schools.--
39     (2)  SCHOOL IMPROVEMENT RATING.--A district An alternative
40school, or a charter school, that provides dropout prevention
41and academic intervention services pursuant to s. 1003.53 shall
42receive a school improvement rating pursuant to this section.
43However, a district an alternative school, or a charter school,
44that provides these services shall not receive a school
45improvement rating if the number of its students for whom
46student performance data is available for the current year and
47previous year is less than the minimum sample size necessary,
48based on accepted professional practice, for statistical
49reliability and prevention of the unlawful release of personally
50identifiable student data under s. 1002.22 or 20 U.S.C. s.
511232g. The school improvement rating shall identify a district
52an alternative school or a charter school as having one of the
53following ratings defined according to rules of the State Board
54of Education:
55     (a)  "Improving" means the students attending the school
56are making more academic progress than when the students were
57served in their home schools.
58     (b)  "Maintaining" means the students attending the school
59are making progress equivalent to the progress made when the
60students were served in their home schools.
61     (c)  "Declining" means the students attending the school
62are making less academic progress than when the students were
63served in their home schools.

65The school improvement rating shall be based on a comparison of
66student performance data for the current year and previous year.
67Schools that improve at least one level or maintain an
68"improving" rating pursuant to this section are eligible for
69school recognition awards pursuant to s. 1008.36.
