    1         Senate Amendment (with title amendment)

    4  insert:
    5         Section 2. Section 11.13, Florida Statutes, is amended to
    6  read:
    7         11.13 Compensation of members; powers and duties.—
    8         (1)(a) The annual salaries of members of the Senate and
    9  House of Representatives, payable in 12 equal monthly
   10  installments, shall be:
   11         1. The President of the Senate and Speaker of the House of
   12  Representatives, $42,066 $25,000 each.
   13         2. All other members of the Senate and House of
   14  Representatives, $30,335.40 $18,000 each.
   15         (b) Effective July 1, 1986, and each July 1 thereafter, the
   16  annual salaries of members of the Senate and House of
   17  Representatives shall be adjusted by the average percentage
   18  increase in the salaries of state career service employees for
   19  the fiscal year just concluded. The Appropriations Committee of
   20  each house shall certify to the Office of Legislative Services
   21  the average percentage increase in the salaries of state career
   22  service employees before July 1 of each year. The Office of
   23  Legislative Services shall, as of July 1 of each year, determine
   24  the adjusted annual salaries as provided herein.
   25         (2) During the time the Legislature is in session, each
   26  legislator shall be paid subsistence at a rate to be established
   27  by the President of the Senate for members of the Senate and the
   28  Speaker of the House of Representatives for members of the
   29  House. Each legislator, in addition to subsistence, shall be
   30  paid travel expenses in accordance with s. 112.061(7) and (8)
   31  for actual travel between the legislator’s home and the seat of
   32  government for not more than one round trip per week or fraction
   33  of a week during any regular, special, or extraordinary session
   34  of the Legislature or for the convening of either the House or
   35  Senate for official business.
   36         (3) Members of any standing or select committee or
   37  subcommittee thereof shall receive per diem and travel expenses
   38  as provided in s. 112.061 from the appropriation for legislative
   39  expenses.
   40         (4) Each member of the Legislature shall be entitled to
   41  receive a monthly allowance for intradistrict expenses in an
   42  amount set annually by the President of the Senate for members
   43  of the Senate and the Speaker of the House of Representatives
   44  for members of the House. In setting the amount, the costs of
   45  maintaining a legislative district office or offices that
   46  provide an appropriate level of constituent services shall be
   47  considered. The procedure for disbursement of the monthly
   48  intradistrict expense allowed shall be set from time to time by
   49  the Office of Legislative Services, with the approval of the
   50  President of the Senate and the Speaker of the House of
   51  Representatives or their respective designees. Such expenses
   52  shall be a proper expense of the Legislature and shall be
   53  disbursed from the appropriation for legislative expense. The
   54  expenses provided under this subsection shall not include any
   55  travel and per diem reimbursed under subsections (2) and (3) or
   56  the rules of either house.
   57         (5)(a) All expenditures of the Senate, House of
   58  Representatives, and offices, committees, and divisions of the
   59  Legislature shall be made pursuant to and, unless changed as
   60  provided below, within the limits of budgetary estimates of
   61  expenditure for each fiscal year prepared and submitted prior to
   62  June 15 by the administrative head of each such house, office,
   63  committee, or division and approved by the President of the
   64  Senate as to Senate budgets, by the Speaker of the House of
   65  Representatives as to House budgets, and by the President of the
   66  Senate and the Speaker of the House of Representatives acting
   67  jointly as to joint committees and other units of the
   68  Legislature. Amounts in the approved estimates of expenditure
   69  may be transferred between budgetary units within the Senate,
   70  House of Representatives, and joint activities by the original
   71  approving authority. Funds may be transferred between items of
   72  appropriation to the Legislature when approved by the President
   73  of the Senate and the Speaker of the House of Representatives,
   74  provided the total amount appropriated to the legislative branch
   75  shall not be altered. The Office of Legislative Services shall
   76  formulate and present to each house and office thereof
   77  recommendations concerning the form and preparation of such
   78  budgets and procedures for their adoption and transmission.
   79         (b) Thirty days prior to the date established by s. 216.023
   80  for submission of legislative budgets by all state agencies to
   81  the Governor, all budgetary units required to submit estimates
   82  of expenditures as provided by paragraph (a) shall annually
   83  submit tentative estimates of their financial needs for the next
   84  fiscal year beginning July 1 to the authorities required by that
   85  paragraph so that the financial needs of the Legislature for the
   86  ensuing fiscal year may be reported to the Governor by the
   87  President of the Senate and the Speaker of the House of
   88  Representatives as required by s. 216.081.
   89         (c) The Office of Legislative Services shall submit on
   90  forms prescribed by the Chief Financial Officer requested
   91  allotments of appropriations for the fiscal year. It shall be
   92  the duty of the Chief Financial Officer to release the funds and
   93  authorize the expenditures for the legislative branch to be made
   94  from the appropriations on the basis of the requested
   95  allotments. However, the aggregate of such allotments shall not
   96  exceed the total appropriations available for the fiscal year.
   97         (6) The pay of members of the Senate and House of
   98  Representatives shall be only as set by law.
   99         (7)The powers and duties of members of the Senate and
  100  House of Representatives, include, but are not limited to the
  101  following, pursuant to the state constitution, general law, and
  102  the rules adopted by the respective bodies:
  103         (a)Providing for the generation of revenue to meet the
  104  needs and expenses set forth in the state budget and balancing
  105  and curing deficits as prescribed by the constitution and
  106  general law;
  107         (b)Filing bills to become constitutional amendments,
  108  general law, or local law;
  109         (c)Faithfully pursuing district priorities without
  110  compromising statewide priorities;
  111         (d)Conducting business with other members or persons,
  112  whether in an official or committee capacity; pursuant to the
  113  oath of office prescribed in s. 876.05 and s. 5, Art. II, State
  114  Constitution; and
  115         (e)Avoiding any form or appearance of a conflict of
  116  interest or personal self-enrichment not in order of the office.

  118  A member who violates this subsection commits a breach of the
  119  public trust as defined in chapter 112 and is subject to
  120  prosecution by the Commission on Ethics upon the filing of a
  121  complaint with the commission.
