1 A bill to be entitled
2 An act relating to career and adult education;
3 amending s. 20.15, F.S.; renaming the Division of
4 Workforce Education within the Department of Education
5 as the “Division of Career and Adult Education”;
6 amending s. 311.121, F.S.; revising the membership of
7 the Seaport Security Officer Qualification, Training,
8 and Standards Coordinating Council by replacing the
9 chancellor of the Community College System with the
10 Commissioner of Education; amending s. 1003.4285,
11 F.S.; providing a cross-reference; conforming
12 provisions to changes made by the act; amending s.
13 1003.43, F.S.; providing an exception for adult high
14 school students regarding certain prerequisites for
15 high school graduation; amending s. 1003.431, F.S.;
16 revising the requirements that a student must meet in
17 order to receive a designation on his or her high
18 school diploma for industry-certified career education
19 certification; providing an effective date.

21 Be It Enacted by the Legislature of the State of Florida:
22
23 Section 1. Paragraph (c) of subsection (3) of section
24 20.15, Florida Statutes, is amended to read:
25 20.15 Department of Education.—There is created a
26 Department of Education.
27 (3) DIVISIONS.—The following divisions of the Department of
28 Education are established:
29 (c) Division of Career and Adult Education Workforce
30 Education.
31 Section 2. Paragraph (b) of subsection (3) of section
32 311.121, Florida Statutes, is amended to read:
33 311.121 Qualifications, training, and certification of
34 licensed security officers at Florida seaports.—
35 (3)
36 (b)1. The executive director of the Department of Law
37 Enforcement shall appoint 11 members to the council which shall
38 include:
39 a. The seaport administrator of the Department of Law
40 Enforcement.
41 b. The Commissioner of Education or his or her designee
42 chancellor of the Community College System.
43 c. The director of the Division of Licensing of the
44 Department of Agriculture and Consumer Services.
45 d. The administrator of the Florida Seaport Transportation
46 and Economic Development Council.
47 e. Two seaport security directors from seaports designated
48 under s. 311.09.
49 f. One director of a state law enforcement academy.
50 g. One representative of a local law enforcement agency.
51 h. Two representatives of contract security services.
52 i. One representative of the Division of Driver Licenses of
53 the Department of Highway Safety and Motor Vehicles.
54 2. In addition to the members designated in subparagraph
55 1., the executive director may invite a representative of the
56 United States Coast Guard to attend and participate in council
57 meetings as an ex officio, nonvoting member of the council.
58 Section 3. Section 1003.4285, Florida Statutes, is amended
59 to read:
60 1003.4285 Standard high school diploma designations.—By the
61 2008-2009 school year, Each standard high school diploma shall
62 include, as applicable:
63 (1) A designation of the student's major area of interest
64 pursuant to the student's completion of credits as provided in
65 s. 1003.428.
66 (2) A designation reflecting completion of four or more
67 accelerated college credit courses if the student is eligible
68 for college credit pursuant to s. 1007.27 or s. 1007.271 in
69 Advanced Placement, International Baccalaureate, Advanced
70 International Certificate of Education, or dual enrollment
71 courses. The Commissioner of Education shall establish
72 guidelines for successful passage of examinations or coursework
73 in each of the accelerated college credit options for purposes
74 of this subsection.
75 (3) A designation reflecting industry-certified career
76 education certification in accordance with ss. 1003.431 and
77 1003.492 s. 1003.431.
78 (4) A designation reflecting a Florida Ready to Work
79 Credential in accordance with s. 1004.99.
80 Section 4. Paragraph (c) of subsection (6) of section
81 1003.43, Florida Statutes, is amended to read:
82 1003.43 General requirements for high school graduation.—
83 (6) The Legislature recognizes that adult learners are
84 unique in situation and needs. The following graduation
85 requirements are therefore instituted for students enrolled in
86 adult general education in accordance with s. 1004.93 in pursuit
87 of a high school diploma:
88 (c) Any course listed within the Department of Education
89 Course Code Directory in the areas of art, dance, drama, or
90 music may be undertaken by adult secondary education students.
91 However, adult high school students are not required to complete
92 a credit in performing arts as a prerequisite for high school
93 graduation. Enrollment and satisfactory completion of such a
94 course shall satisfy the credit in performing fine arts required
95 for high school graduation pursuant to subsection (1).
96 Section 5. Section 1003.431, Florida Statutes, is amended
97 to read:
98 1003.431 Industry-certified career education
99 certification.—
100 (1) A student who fulfills the following requirements shall
101 be recognized with an industry-certified a career education
102 certification on his or her high school diploma:
103 (a) Completion of the requirements for high school
104 graduation as provided in s. 1003.429 or s. 1003.43 and the
105 additional requirements for a comprehensive career education
106 program of study as provided in subsection (2).
107 (b) Completion of one or more certifications from the list
108 of industry certifications approved by Workforce Florida, Inc.,
109 pursuant to s. 1003.492(2). The approved list of industry
110 certifications when a student enters grade 9 and any industry
111 certifications added through grade 12 which are completed by the
112 student are eligible for designation on his or her high school
113 diploma. A passing score on the college entry-level placement
114 test or an equivalent test identified by the Department of
115 Education with a score adequate to enroll in a public
116 postsecondary educational program without the need for college
117 preparatory or career preparatory instruction.
118 (2) A comprehensive program of study in career education
119 shall be designed to prepare a student to continue his or her
120 education at a postsecondary educational institution and obtain
121 employment. A comprehensive career education program of study
122 must require of each student:
123 (a) Completion of academic courses with a designation from
124 the Department of Education of level two or above. All credits
125 earned to meet graduation requirements in mathematics, science,
126 and communication must have that designation.
127 (b) Attainment of at least one occupational completion
128 point in an industry-certified career education program or
129 completion of at least two courses in a technology education
130 program.
131 (c) Completion of a one-credit course addressing workplace
132 readiness skills. The course requirement may be satisfied by
133 infusing course content into an existing select career and
134 education course. The State Board of Education shall define by
135 rule the content of the course and shall ensure that the course
136 meets graduation requirements for performing fine arts or
137 practical arts.
138 (d) Participation in work-based learning experiences, as
139 defined by rule by the State Board of Education.
140 (e) Participation in a capstone activity that includes a
141 project related to a career. This activity is designed to apply
142 and demonstrate the competencies and concepts attained in the
143 student's program of study. The State Board of Education may
144 specify by rule characteristics of capstone activities that meet
145 the intent of this paragraph.
146 (2)(3) The industry-certified career education
147 certification indicates that the student is prepared to continue
148 into postsecondary education without the need for remediation
149 and that the student has attained marketable employment skills
150 and is prepared to enter the workforce. The State Board of
151 Education may adopt by rule a standard format for the
152 certification.
153 (4) A school district is not required to offer a
154 comprehensive career education program pursuant to this section.
155 However, for each student who receives the career education
156 certification on his or her high school diploma, the school
157 district may receive incentive funding contingent upon funding
158 in the annual General Appropriations Act.
159 (5) A school district that generates funds as a result of
160 incentive funding for student achievement of the career
161 education certification on the high school diploma must expend
162 the total amount on the comprehensive career education program
163 of study. The school district may not apply indirect charges to
164 incentive funds earned.
165 Section 6. This act shall take effect July 1, 2009.
