1 A bill to be entitled
2 An act relating to long-term care services; amending
3 s. 430.707, F.S.; requiring the Agency for Health Care
4 Administration, in consultation with the Department of
5 Elderly Affairs, to accept and forward to the Centers
6 for Medicare and Medicaid Services an application for
7 expansion of a pilot project from an entity that
8 provides certain benefits under a federal program;
9 providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 430.707, Florida Statutes, is amended to
14 read:
15 430.707 Contracts.—
16 (1) The department, in consultation with the agency, shall
17 select and contract with managed care organizations and, on a
18 prepaid basis, with other qualified providers as defined in s.
19 430.703(7) to provide long-term care within community diversion
20 pilot project areas. All providers shall report quarterly to the
21 department regarding the entity's compliance with all the
22 financial and quality assurance requirements of the contract.
23 (2) The department, in consultation with the agency, may
24 contract with entities that which have submitted an application
25 as a community nursing home diversion project as of July 1,
26 1998, to provide benefits pursuant to the “Program of All
27 inclusive Care for the Elderly” as established in Pub. L. No.
28 105-33. For the purposes of this community nursing home
29 diversion project, such entities are shall be exempt from the
30 requirements of chapter 641, if the entity is a private,
31 nonprofit, superior-rated nursing home and if with at least 50
32 percent of its residents are eligible for Medicaid. The agency,
33 in consultation with the department, shall accept and forward to
34 the Centers for Medicare and Medicaid Services an application
35 for expansion of the pilot project from an entity that provides
36 benefits pursuant to the Program of All-inclusive Care for the
37 Elderly and that is in good standing with the agency, the
38 department, and the Centers for Medicare and Medicaid Services.
39 Section 2. This act shall take effect July 1, 2009.
