       The Committee on Health and Human Services Appropriations (Rich)
       recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 351 - 355
    4  and insert:
    5         Section 8. Paragraph (d) is added to subsection (3) of
    6  section 409.9082, Florida Statutes, as created by section 1 of
    7  chapter 2009-4, Laws of Florida, and subsection (6) of that
    8  section is amended, to read:
    9         409.9082 Quality assessment on nursing home facility
   10  providers; exemptions; purpose; federal approval required;
   11  remedies.—
   12         (3)
   13         (d) Effective July 1, 2009, the agency may exempt from the
   14  quality assessment or apply a lower quality assessment rate to a
   15  qualified public, nonstate owned or operated nursing home
   16  facility whose total annual indigent census days are greater
   17  than 25 percent of the facility’s total annual census days.
