Florida Senate - 2009 PROPOSED COMMITTEE SUBSTITUTE Bill No. SB 1666 Barcode 828346 603-03375-09 Proposed Committee Substitute by the Committee on Health and Human Services Appropriations 1 A bill to be entitled 2 An act relating to community-based agencies; amending 3 s. 409.1671, F.S.; requiring the Department of 4 Children and Family Services to ensure that contracts 5 entered into with community-based agencies are funded 6 by a grant of general revenue and federal funding 7 sources; requiring community-based agencies to 8 document federal earnings; authorizing the department 9 to contract for the oversight of the community-based 10 agencies; specifying permissible expenditures; 11 requiring the department to enter into certain 12 contracts with community-based agencies; authorizing 13 community-based agencies to retain any interest earned 14 on advances to expend on allowable child welfare and 15 related services; requiring the department to develop 16 reporting requirements; providing an effective date. 17 18 Be It Enacted by the Legislature of the State of Florida: 19 20 Section 1. Subsections (12), (13), and (14) are added to 21 section 409.1671, Florida Statutes, to read: 22 409.1671 Foster care and related services; outsourcing.— 23 (12) The department shall ensure that a contract entered 24 into with each community-based agency pursuant to this section 25 is funded by a grant of general revenue and by applicable 26 federal funding sources. Each community-based agency is 27 responsible for documenting federal earnings, and federal 28 earnings not documented shall be returned to the department. 29 Notwithstanding subsection (8), each community-based agency’s 30 annual contract amount may be increased by excess federal 31 earnings in accordance with s. 216.181(11). The department may 32 contract for the programmatic, administration, or fiscal 33 oversight of each community-based agency. Notwithstanding any 34 other provision of law, the following community-based-agency 35 expenditures are permissible: 36 (a) Cellular telephone allowances for staff; 37 (b) Contracts requiring deferred payments and maintenance 38 agreements; 39 (c) Security deposits for office leases; 40 (d) Related professional membership dues and professional 41 state license fees; 42 (e) Food and refreshment; and 43 (f) Promotional materials. 44 (13) The department shall enter into a fixed-price contract 45 with each community-based agency which has a 2-month advance 46 payment at the beginning of the fiscal year followed by equal 47 monthly payments. 48 (14) Notwithstanding s. 216.181(16)(b), each community 49 based agency may retain any interest earned on advances to 50 expend on allowable child welfare and related services. The 51 department shall develop reporting requirements that require 52 each community-based agency to annually document its interest 53 earnings and associated expenditures. 54 Section 2. This act shall take effect July 1, 2009.
