8 | or memoranda of agreement with other agencies of the |
9 | state, public-private partnerships, and other arrangements |
10 | for specified purposes; providing an appropriation; |
11 | providing requirements for the release of the |
12 | appropriation; providing an effective date. |

14 | Be It Enacted by the Legislature of the State of Florida: |
15 |

16 | Section 1. Section 377.807, Florida Statutes, is created |
17 | to read: |
18 | 377.807 Energy-efficient appliance rebate program.-- |
19 | (1) The Florida Energy and Climate Commission is |
20 | authorized to develop and administer a consumer rebate program |
21 | for residential energy-efficient appliances, consistent with 42 |
22 | U.S.C. s. 15821 and any federal agency guidance or regulations |
23 | issued in furtherance of federal law. |
24 | (2) The commission may adopt rules pursuant to ss. |
25 | 120.536(1) and 120.54 designating eligible appliances, rebate |
26 | amounts, and the administration of the issuance of rebates. The |
27 | rules shall be consistent with 42 U.S.C. s. 15821 and any |
28 | subsequent implementing federal regulations or guidance. |
29 | (3) The commission is authorized to enter into contracts |
30 | or memoranda of agreement with other agencies of the state, |
31 | public-private partnerships, or other arrangements such that the |
32 | most efficient means of administering consumer rebates can be |
33 | achieved. |
34 | Section 2. For the 2009-2010 fiscal year, the sum of |
35 | $150,000 is appropriated from the General Revenue Fund to the |
36 | Florida Energy and Climate Commission for the purpose of |
37 | administering the energy-efficient appliance rebate program; |
38 | however, the funds shall not be released to the commission until |
39 | it has submitted a report to the Legislative Budget Commission |
40 | certifying that the energy-efficient appliance rebate program |
41 | complies with 42 U.S.C. s. 15821 and any subsequent implementing |
42 | federal regulations and that the state will receive funds |
43 | pursuant to 42 U.S.C. s. 15821 and the American Recovery and |
44 | Reinvestment Act of 2009 to implement the energy-efficient |
45 | appliance rebate program. |
46 | Section 3. This act shall take effect July 1, 2009. |
