The Conference Committee on CS for SB 1720 recommended the
following:
1 Senate Conference Committee Amendment (with title
2 amendment)

4 Delete everything after the enacting clause
5 and insert:
6 Section 1. Capital Collateral Regional Counsel Trust Fund.—
7 (1) The Capital Collateral Regional Counsel Trust Fund is
8 created within the Justice Administrative Commission. Moneys
9 credited to the trust fund shall be used for the purpose of
10 funding the activities of the capital collateral regional
11 counsels.
12 (2) In accordance with s. 19(f)(2), Art. III of the State
13 Constitution, the Capital Collateral Regional Counsel Trust Fund
14 shall, unless terminated sooner, be terminated on July 1, 2013.
15 Before its scheduled termination, the trust fund shall be
16 reviewed as provided in s. 215.3206(1) and (2), Florida
17 Statutes.
18 Section 2. Paragraph (a) of subsection (3) of section
19 27.702, Florida Statutes, is amended to read:
20 27.702 Duties of the capital collateral regional counsel;
21 reports.—
22 (3)(a) The capital collateral regional counsel shall file
23 motions seeking compensation for representation and
24 reimbursement for expenses pursuant to 18 U.S.C. s. 3006A when
25 providing representation to indigent persons in the federal
26 courts, and shall deposit all such payments received into the
27 Capital Collateral Regional Counsel Trust General Revenue Fund.
28 Section 3. This act shall take effect July 1, 2009.

34 A bill to be entitled
35 An act relating to trust funds; creating the Capital
36 Collateral Regional Counsel Trust Fund; specifying the
37 purposes of the trust fund; providing for future
38 review and termination or re-creation of the trust
39 fund; amending s. 27.702, F.S.; providing for the
40 deposit of funds reimbursing the state for
41 representation of certain indigent persons into the
42 Capital Collateral Regional Counsel Trust Fund;
43 providing an effective date.
