    1                        A bill to be entitled                      
    2         An act relating to trust funds; creating the Capital
    3         Collateral Regional Counsel Trust Fund; specifying the
    4         purposes of the trust fund; providing for future
    5         review and termination or re-creation of the trust
    6         fund; amending s. 27.702, F.S.; providing for the
    7         deposit of funds reimbursing the state for
    8         representation of certain indigent persons into the
    9         Capital Collateral Regional Counsel Trust Fund;
   10         providing an effective date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Capital Collateral Regional Counsel Trust Fund.—
   15         (1) The Capital Collateral Regional Counsel Trust Fund is
   16  created within the Justice Administrative Commission. Moneys
   17  credited to the trust fund shall be used for the purpose of
   18  funding the activities of the capital collateral regional
   19  counsels.
   20         (2) In accordance with s. 19(f)(2), Art. III of the State
   21  Constitution, the Capital Collateral Regional Counsel Trust Fund
   22  shall, unless terminated sooner, be terminated on July 1, 2013.
   23  Before its scheduled termination, the trust fund shall be
   24  reviewed as provided in s. 215.3206(1) and (2), Florida
   25  Statutes.
   26         Section 2. Paragraph (a) of subsection (3) of section
   27  27.702, Florida Statutes, is amended to read:
   28         27.702 Duties of the capital collateral regional counsel;
   29  reports.—
   30         (3)(a) The capital collateral regional counsel shall file
   31  motions seeking compensation for representation and
   32  reimbursement for expenses pursuant to 18 U.S.C. s. 3006A when
   33  providing representation to indigent persons in the federal
   34  courts, and shall deposit all such payments received into the
   35  Capital Collateral Regional Counsel Trust General Revenue Fund.
   36         Section 3. This act shall take effect July 1, 2009.
