A bill to be entitled
2An act relating to firearms transactions; amending s.
3790.335, F.S.; clarifying that violations of provisions
4prohibiting keeping any list, record, or registry of
5privately owned firearms or any list, record, or registry
6of the owners of those firearms may be committed by
7entities as well as individuals; requiring that secondhand
8dealers and pawnbrokers who electronically submit certain
9firearm transaction records to law enforcement agencies
10submit specified information in Florida Crime Information
11Center coding; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:

15     Section 1.  Paragraph (a) of subsection (4) of section
16790.335, Florida Statutes, is amended, present subsection (5) is
17renumbered as subsection (6), and a new subsection (5) is added
18to that section, to read:
19     790.335  Prohibition of registration of firearms;
20electronic records.--
21     (4)  PENALTIES.--
22     (a)  Any person who, or entity that, violates a provision
23of this section commits a felony of the third degree, punishable
24as provided in s. 775.082 or s. 775.083.
25     (5)  ELECTRONIC RECORDS.--Secondhand dealers and
26pawnbrokers who electronically submit firearms transaction
27records to the appropriate law enforcement agencies as required
28by chapters 538 and 539 shall submit the name of the
29manufacturer, model, serial number, and caliber information of
30each firearm in Florida Crime Information Center coding.
31     Section 2.  This act shall take effect July 1, 2009.
