8 | dealers and pawnbrokers who electronically submit certain |
9 | firearm transaction records to law enforcement agencies |
10 | submit certain specified information in Florida Crime |
11 | Information Center coding; providing an effective date. |

13 | Be It Enacted by the Legislature of the State of Florida: |
14 |

15 | Section 1. Paragraph (a) of subsection (4) of section |
16 | 790.335, Florida Statutes, is amended, present subsection (5) is |
17 | renumbered as subsection (6), and a new subsection (5) is added |
18 | to that section, to read: |
19 | 790.335 Prohibition of registration of firearms; |
20 | electronic records.-- |
21 | (4) PENALTIES.-- |
22 | (a) Any person who, or entity that, violates a provision |
23 | of this section commits a felony of the third degree, punishable |
24 | as provided in s. 775.082 or s. 775.083. |
25 | (5) ELECTRONIC RECORDS.--Secondhand dealers and |
26 | pawnbrokers who electronically submit firearms transaction |
27 | records to the appropriate law enforcement agencies as required |
28 | by chapters 538 and 539 shall submit the name of the |
29 | manufacturer and caliber information of each firearm in Florida |
30 | Crime Information Center coding, and shall include the model and |
31 | serial number of each firearm. |
32 | Section 2. This act shall take effect July 1, 2009. |
