1 A bill to be entitled
2 An act relating to the state group insurance program;
3 amending s. 110.123, F.S.; providing the state’s
4 monthly contribution to an employee’s health savings
5 account for the 2009-2010 fiscal year; deleting a
6 provision that requires that health savings accounts
7 be administered in accordance with the federal
8 requirements and limitations of the Medicare
9 Prescription Drug, Improvement, and Modernization Act;
10 providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsection (12) of section 110.123, Florida
15 Statutes, is amended to read:
16 110.123 State group insurance program.—
17 (12) HEALTH SAVINGS ACCOUNTS.—The department is authorized
18 to establish health savings accounts for full-time and part-time
19 state employees in association with a health insurance plan
20 option authorized by the Legislature and conforming to the
21 requirements and limitations of federal provisions relating to
22 the Medicare Prescription Drug, Improvement, and Modernization
23 Act of 2003.
24 (a)1. A member participating in this health insurance plan
25 option shall be eligible to receive an employer contribution
26 into the employee’s health savings account from the State
27 Employees Health Insurance Trust Fund in an amount to be
28 determined by the Legislature. A member is not eligible for an
29 employer contribution upon termination of employment. For the
30 2009-2010 2008-2009 fiscal year, the state’s monthly
31 contribution for employees having individual coverage shall be
32 $41.66 and the monthly contribution for employees having family
33 coverage shall be $83.33.
34 2. A member participating in this health insurance plan
35 option shall be eligible to deposit the member’s own funds into
36 a health savings account.
37 (b) The monthly premiums paid by the employer for a member
38 participating in this health insurance plan option shall include
39 an amount equal to the monthly employer contribution authorized
40 by the Legislature for that fiscal year.
41 (c) The health savings accounts shall be administered in
42 accordance with the requirements and limitations of federal
43 provisions relating to the Medicare Prescription Drug,
44 Improvement, and Modernization Act of 2003.
45 Section 2. This act shall take effect July 1, 2009.
