Florida Senate - 2009 CS for SB 1824 By the Committees on Governmental Oversight and Accountability; and Community Affairs 585-05758-09 20091824c1 1 A bill to be entitled 2 An act relating to a review under the Open Government 3 Sunset Review Act; amending s. 119.071, F.S., relating 4 to an exemption from public-records requirements for 5 information that would identify or locate a child who 6 participates in a government-sponsored recreation 7 program or a parent or guardian of the child; 8 providing definitions; reorganizing the exemption and 9 making editorial changes; saving the exemption from 10 repeal under the Open Government Sunset Review Act; 11 repealing s. 2, ch. 2004-32, Laws of Florida, which 12 provides for repeal of the exemption; providing an 13 effective date. 14 15 Be It Enacted by the Legislature of the State of Florida: 16 17 Section 1. Paragraph (c) of subsection (5) of section 18 119.071, Florida Statutes, is amended to read: 19 119.071 General exemptions from inspection or copying of 20 public records.— 21 (5) OTHER PERSONAL INFORMATION.— 22 (c)1. For purposes of this paragraph, the term: 23 a. “Child” means any person younger than 18 years of age. 24 b. “Government-sponsored recreation program” means a 25 program for which an agency assumes responsibility for a child 26 participating in that program, including, but not limited to, 27 after-school programs, athletic programs, nature programs, 28 summer camps, or other recreational programs. 29 2.AnyInformation that would identify orhelp tolocate a 30 child who participates in a government-sponsored recreation 31 programprograms or camps or the parents or guardians of such32child, including, but not limited to, the name, home address,33telephone number, social security number, or photograph of the34child; the names and locations of schools attended by such35child; and the names, home addresses, and social security36numbers of parents or guardians of such childis exempt from s. 37 119.07(1) and s. 24(a), Art. I of the State Constitution. 38Information made exempt pursuant to this paragraph may be39disclosed by court order upon a showing of good cause.40 3. Information that would identify or locate a parent or 41 guardian of a child who participates in a government-sponsored 42 recreation program is exempt from s. 119.07(1) and s. 24(a), 43 Art. I of the State Constitution. 44 4. This exemption applies to records held before, on, or 45 after the effective date of this exemption. 46 Section 2. Section 2 of chapter 2004-32, Laws of Florida, 47 is repealed. 48 Section 3. This act shall take effect October 1, 2009.
