       Senators Crist and Joyner moved the following:
       
    1         Senate Amendment (with title amendment)

    4         Delete lines 349 - 364
    5  and insert:
    6         (1) For the purposes of this section, the term “tobacco
    7  products” means loose tobacco suitable for smoking; snuff; snuff
    8  flour; cavendish; plug and twist tobacco; fine cuts and other
    9  chewing tobaccos; shorts; refuse scraps; clippings, cuttings,
   10  and sweepings of tobacco, and other kinds and forms of tobacco
   11  prepared in such manner as to be suitable for chewing. However,
   12  the term does not include cigarettes, as defined by s.
   13  210.01(1), or cigars.
   14         (2) A surcharge is levied upon all tobacco products in this
   15  state and upon any person engaged in business as a distributor
   16  thereof at the rate of $1 for each ounce, with a proportionate
   17  surcharge at the same rate on all fractions of an ounce thereof,
   18  of such tobacco products. The surcharge shall be levied at the
   19  time the distributor:

   24  and insert:
   25  surcharge on tobacco products other than cigarettes or cigars;
