Florida Senate - 2009 SB 1868 By Senator Peaden 2-01738-09 20091868__ 1 A bill to be entitled 2 An act relating to pharmacies; amending ss. 465.003 3 and 465.019, F.S.; authorizing the use of an 4 institutional formulary system in a Class I 5 institutional pharmacy at which, with certain 6 exceptions, all medicinal drugs are administered from 7 individual prescription containers to the patient and 8 medicinal drugs are not dispensed on the premises; 9 providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Subsection (7) of section 465.003, Florida 14 Statutes, is amended to read: 15 465.003 Definitions.—As used in this chapter, the term: 16 (7) “Institutional formulary system” means a method whereby 17 the medical staff evaluates, appraises, and selects those 18 medicinal drugs or proprietary preparations which in the medical 19 staff's clinical judgment are most useful in patient care, and 20 which are available for dispensing by a practicing pharmacist in 21 a Class I or Class II institutional pharmacy. 22 Section 2. Subsection (6) of section 465.019, Florida 23 Statutes, is amended to read: 24 465.019 Institutional pharmacies; permits.— 25 (6) In a Class I or Class II institutional pharmacy, an 26 institutional formulary system may be adopted with approval of 27 the medical staff for the purpose of identifying those medicinal 28 drugs and proprietary preparations that may be dispensed by the 29 pharmacists employed in such institution. A facility with a 30 Class I or Class II institutional permit which is operating 31 under the formulary system shall establish policies and 32 procedures for the development of the system, in accordance with 33 the joint standards of the American Hospital Association and 34 American Society of Hospital Pharmacists, for the use 35utilizationof an institutionala hospitalformulary system, 36 which formulary shall be approved by the medical staff. 37 Section 3. This act shall take effect July 1, 2009.
