    1                        A bill to be entitled                      
    2         An act relating to state inmates; authorizing a
    3         nonprofit or public health care organization to
    4         distribute sexual barrier protection devices to
    5         inmates in the state correctional system; requiring
    6         the Department of Corrections to develop a plan to
    7         properly dispose of used sexual barrier protection
    8         devices; providing an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11         
   12         Section 1. (1) The Department of Corrections shall allow
   13  any nonprofit or public health care organization to distribute
   14  sexual barrier protection devices, such as condoms, to inmates
   15  in the state correctional system. The health care organization
   16  is subject to all laws and rules governing visitors to a
   17  correctional facility.
   18         (2) The distribution of sexual barrier protection devices
   19  is not a crime and is not deemed to encourage sexual acts
   20  between inmates.
   21         (3) The Department of Corrections may not use possession of
   22  a device distributed under subsection (1) as evidence of illegal
   23  activity for purposes of administrative sanctions.
   24         (4) The Department of Corrections shall develop a plan for
   25  disposing of used sexual barrier protection devices which
   26  protects the anonymity of inmates and the health of correctional
   27  officers.
   28         Section 2. This act shall take effect July 1, 2009.
