House Comm: RCS . 04/15/2009 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Health Regulation (Bennett) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete everything after the enacting clause 4 and insert: 5 Section 1. Section 381.932, Florida Statutes, is created to 6 read: 7 381.932 Breast cancer early detection and treatment 8 referral program.— 9 (1) For purposes of this section, the term: 10 (a) “Breast cancer screening and referral services” means 11 necessary breast cancer screening and referral services for a 12 procedure intended to treat cancer of the human breast, 13 including, but not limited to, surgery, radiation therapy, 14 chemotherapy, hormonal therapy, and related medical followup 15 services. 16 (b) “Unserved or underserved populations” means women who 17 are: 18 1. At or below 200 percent of the federal poverty level for 19 individuals; 20 2. Without health insurance that covers breast cancer 21 screenings; and 22 3. Nineteen to 64 years of age, inclusive. 23 (2) There is established, within existing or specific 24 appropriations, a breast cancer early detection and treatment 25 referral program within the Department of Health. The purposes 26 of the program are to: 27 (a) Promote referrals for the screening, detection, and 28 treatment of breast cancer among unserved or underserved 29 populations. 30 (b) Educate the public regarding breast cancer and the 31 benefits of early detection. 32 (c) Provide referral services for persons seeking 33 treatment. 34 (3) The program shall include, but not be limited to, the: 35 (a) Establishment of a public education and outreach 36 initiative to publicize breast cancer early detection services, 37 the benefits of early detection of breast cancer, and the 38 recommended frequency for receiving screening services, 39 including clinical breast examinations and mammography 40 guidelines established by the United States Preventive Services 41 Task Force. 42 (b) Development of professional education programs that 43 include information regarding the benefits of the early 44 detection of breast cancer and the recommended frequency for 45 receiving a mammogram, as recommended in the most current breast 46 cancer screening guidelines established by the United States 47 Preventive Services Task Force. 48 (c) Establishment of a system to track and monitor all 49 women screened for breast cancer in the program. The system 50 shall include, but not be limited to, monitoring abnormal 51 screening tests, referring women for treatment when needed, and 52 tracking women to be screened at recommended screening 53 intervals. 54 (4) The State Surgeon General shall submit an annual report 55 to the appropriate substantive committees of the Legislature. 56 The report shall include, but not be limited to, a description 57 of the rate of breast cancer morbidity and mortality in the 58 state and the extent to which women are participating in breast 59 cancer screening as reported by the Behavioral Risk Factor 60 Surveillance System. 61 Section 2. This act shall take effect July 1, 2009. 62 63 64 ================= T I T L E A M E N D M E N T ================ 65 And the title is amended as follows: 66 Delete everything before the enacting clause 67 and insert: 68 A bill to be entitled 69 An act relating to breast cancer detection and 70 screening; creating s. 381.932, F.S.; providing 71 definitions; establishing a breast cancer early 72 detection and treatment referral program within the 73 Department of Health; providing purposes of the 74 program; requiring the department to provide 75 information regarding breast cancer and referrals for 76 screening and treatment; requiring the State Surgeon 77 General to submit a report to the Legislature; 78 providing an effective date.
