Florida Senate - 2009 CS for SB 1880 By the Committee on Health Regulation; and Senator Peaden 588-05177-09 20091880c1 1 A bill to be entitled 2 An act relating to breast cancer detection and 3 screening; creating s. 381.932, F.S.; providing 4 definitions; establishing a breast cancer early 5 detection and treatment referral program within the 6 Department of Health; providing purposes of the 7 program; requiring the department to provide 8 information regarding breast cancer and referrals for 9 screening and treatment; requiring the State Surgeon 10 General to submit a report to the Legislature; 11 providing an effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. Section 381.932, Florida Statutes, is created to 16 read: 17 381.932 Breast cancer early detection and treatment 18 referral program.— 19 (1) For purposes of this section, the term: 20 (a) “Breast cancer screening and referral services” means 21 necessary breast cancer screening and referral services for a 22 procedure intended to treat cancer of the human breast, 23 including, but not limited to, surgery, radiation therapy, 24 chemotherapy, hormonal therapy, and related medical followup 25 services. 26 (b) “Unserved or underserved populations” means women who 27 are: 28 1. At or below 200 percent of the federal poverty level for 29 individuals; 30 2. Without health insurance that covers breast cancer 31 screenings; and 32 3. Nineteen to 64 years of age, inclusive. 33 (2) There is established, within existing or specific 34 appropriations, a breast cancer early detection and treatment 35 referral program within the Department of Health. The purposes 36 of the program are to: 37 (a) Promote referrals for the screening, detection, and 38 treatment of breast cancer among unserved or underserved 39 populations. 40 (b) Educate the public regarding breast cancer and the 41 benefits of early detection. 42 (c) Provide referral services for persons seeking 43 treatment. 44 (3) The program shall include, but not be limited to, the: 45 (a) Establishment of a public education and outreach 46 initiative to publicize breast cancer early detection services, 47 the benefits of early detection of breast cancer, and the 48 recommended frequency for receiving screening services, 49 including clinical breast examinations and mammography 50 guidelines established by the United States Preventive Services 51 Task Force. 52 (b) Development of professional education programs that 53 include information regarding the benefits of the early 54 detection of breast cancer and the recommended frequency for 55 receiving a mammogram, as recommended in the most current breast 56 cancer screening guidelines established by the United States 57 Preventive Services Task Force. 58 (c) Establishment of a system to track and monitor all 59 women screened for breast cancer in the program. The system 60 shall include, but not be limited to, monitoring abnormal 61 screening tests, referring women for treatment when needed, and 62 tracking women to be screened at recommended screening 63 intervals. 64 (4) The State Surgeon General shall submit an annual report 65 to the appropriate substantive committees of the Legislature. 66 The report shall include, but not be limited to, a description 67 of the rate of breast cancer morbidity and mortality in the 68 state and the extent to which women are participating in breast 69 cancer screening as reported by the Behavioral Risk Factor 70 Surveillance System. 71 Section 2. This act shall take effect July 1, 2009.
