Senators Deutch and Richter moved the following:

4 insert:
5 Section 8. Subsection (2) of section 627.711, Florida
6 Statutes, is amended, and subsection (3) is added to that
7 section, to read:
8 627.711 Notice of premium discounts for hurricane loss
9 mitigation; uniform mitigation verification inspection form.—
10 (2) By July 1, 2007, the Financial Services Commission
11 shall develop by rule a uniform mitigation verification
12 inspection form that shall be used by all insurers when
13 submitted by policyholders for the purpose of factoring
14 discounts for wind insurance. In developing the form, the
15 commission shall seek input from insurance, construction, and
16 building code representatives. Further, the commission shall
17 provide guidance as to the length of time the inspection results
18 are valid. An insurer shall accept as valid a uniform mitigation
19 verification form certified by the Department of Financial
20 Services or signed by:
21 (a) A hurricane mitigation inspector certified employed by
22 the an approved My Safe Florida Home program wind certification
23 entity;
24 (b) A building code inspector certified under s. 468.607;
25 (c) A general or residential contractor licensed under s.
26 489.111;
27 (d) A professional engineer licensed under s. 471.015 who
28 has passed the appropriate equivalency test of the Building Code
29 Training Program as required by s. 553.841; or
30 (e) A professional architect licensed under s. 481.213; or
31 (f) Any other individual or entity recognized by the
32 insurer as possessing the necessary qualifications to properly
33 complete a uniform mitigation verification form.
34 (3) An individual or entity who knowingly provides or
35 utters a false or fraudulent mitigation verification form with
36 the intent to obtain or receive a discount on an insurance
37 premium to which the individual or entity is not entitled
38 commits a misdemeanor of the first degree, punishable as
39 provided in s. 775.082 or s. 775.083.

46 627.711, F.S.; requiring that an insurer accept as
47 valid a uniform mitigation verification form certified
48 by the Department of Financial Services or signed by
49 certain individuals or entities; providing a criminal
50 penalty for knowingly submitting a false or fraudulent
51 mitigation form with the intent to receive an
52 undeserved discount; amending s.
