7 | which includes representatives of local law enforcement |
8 | agencies, state attorneys, the Medicaid Fraud Control Unit of |
9 | the Department of Legal Affairs, local fire authorities, the |
10 | Department of Children and Family Services, the district long- |
11 | term care ombudsman council, and the district human rights |
12 | advocacy committee to assist in identifying the operation of |
13 | unlicensed facilities and to develop and implement a plan to |
14 | ensure effective enforcement of state laws relating to such |
15 | facilities. The workgroup shall report its findings, actions, |
16 | and recommendations semiannually to the Director of Health |
17 | Quality Assurance of the agency. |
18 | (3) It is unlawful to knowingly refer a person for |
19 | residency to an unlicensed assisted living facility; to an |
20 | assisted living facility the license of which is under denial or |
21 | has been suspended or revoked; or to an assisted living facility |
22 | that has a moratorium pursuant to part II of chapter 408. Any |
23 | person who violates this subsection commits a noncriminal |
24 | violation, punishable by a fine not exceeding $500 as provided |
25 | in s. 775.083. |
