    1                        A bill to be entitled                      
    2         An act relating to motor vehicle emission standards;
    3         amending s. 316.2937, F.S.; ratifying a rule of the
    4         Department of Environmental Protection which adopts
    5         the California motor vehicle emission standards;
    6         requiring the Department of Environmental Protection
    7         and the Department of Highway Safety and Motor
    8         Vehicles to develop a proposal to implement the rule
    9         and report to the Legislature; providing an effective
   10         date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Section 316.2937, Florida Statutes, is amended
   15  to read:
   16         316.2937 Motor vehicle emissions standards.—Rule 62
   17  285.400, Florida Administrative Code, adopted by If the
   18  Department of Environmental Protection, as filed with the
   19  Secretary of State on January 26, 2009, is proposes to adopt the
   20  California motor vehicle emission standards, such standards
   21  shall not be implemented until ratified by the Legislature. If
   22  the department proposes to modify its rule adopting the
   23  California motor vehicle emission standards, such rule
   24  modifications may shall not be implemented until ratified by the
   25  Legislature. The Department of Environmental Protection and the
   26  Department of Highway Safety and Motor Vehicles shall jointly
   27  develop a proposal to implement the Florida Clean Car Emission
   28  rule which addresses methods for monitoring compliance with the
   29  rule, and shall submit the proposal to the President of the
   30  Senate and the Speaker of the House of Representatives by
   31  January 2, 2010.
   32         Section 2. This act shall take effect July 1, 2009.
