| 7 | Be It Enacted by the Legislature of the State of Florida: |
| 8 |

| 9 | Section 1. A surtax of 25 percent shall be charged on any |
| 10 | of the items listed in s. 893.145, Florida Statutes, regardless |
| 11 | of whether such items are sold for legal purposes or in |
| 12 | violation of the law. The proceeds of this surtax shall be |
| 13 | designated for government drug abuse prevention and treatment |
| 14 | programs. |
| 15 | Section 2. This act shall take effect July 1, 2009. |
