House Joint Resolution
2A joint resolution proposing an amendment to Section 2 of
3Article I of the State Constitution, relating to basic
4rights.

6Be It Resolved by the Legislature of the State of Florida:

8     That the following amendment to Section 2 of Article I of
9the State Constitution is agreed to and shall be submitted to
10the electors of this state for approval or rejection at the next
11general election or at an earlier special election specifically
12authorized by law for that purpose:

ARTICLE I

DECLARATION OF RIGHTS
15     SECTION 2.  Basic rights.--All natural persons, female and
16male alike, are equal before the law and have inalienable
17rights, among which are the right to enjoy and defend life and
18liberty, to pursue happiness, to be rewarded for industry, and
19to acquire, possess and protect property; except that the
20ownership, inheritance, disposition and possession of real
21property by aliens ineligible for citizenship may be regulated
22or prohibited by law. No person shall be deprived of any right
23because of race, religion, national origin, or physical
24disability.
25     BE IT FURTHER RESOLVED that the following statement be
26placed on the ballot:

ARTICLE I, SECTION 2
29     DECLARATION OF RIGHTS.--This amendment to the State
30Constitution eliminates authority granted to the Legislature by
31a constitutional amendment that at the time of its adoption in
321926 allowed the Legislature to regulate or eliminate the real
33property rights of individuals based on race or national origin.
34As a result of this amendment, the Florida Constitution will
35state that all natural persons are equal before the law and have
36an inalienable right to acquire, possess, and protect property,
37without exception.
