The Committee on Criminal Justice (Deutch) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete lines 334 - 390
4 and insert:
5 Section 2. Subsection (2) of section 627.711, Florida
6 Statutes, is amended, and subsection (3) is added to that
7 section, to read:
8 627.711 Notice of premium discounts for hurricane loss
9 mitigation; uniform mitigation verification inspection form.—
10 (2) By July 1, 2007, the Financial Services Commission
11 shall develop by rule a uniform mitigation verification
12 inspection form that shall be used by all insurers when
13 submitted by policyholders for the purpose of factoring
14 discounts for wind insurance. In developing the form, the
15 commission shall seek input from insurance, construction, and
16 building code representatives. Further, the commission shall
17 provide guidance as to the length of time the inspection results
18 are valid. An insurer shall accept as valid a uniform mitigation
19 verification form certified by the Department of Financial
20 Services or signed by:
21 (a) A hurricane mitigation inspector employed by an
22 approved My Safe Florida Home wind certification entity;
23 (b) A building code inspector certified under s. 468.607;
24 (c) A general or residential contractor licensed under s.
25 489.111;
26 (d) A professional engineer licensed under s. 471.015 who
27 has passed the appropriate equivalency test of the Building Code
28 Training Program as required by s. 553.841; or
29 (e) A professional architect licensed under s. 481.213.

32 And the title is amended as follows:

34 and insert:
35 the Legislative Budget Commission; amending s.
36 627.711, F.S.; deleting provisions requiring an
37 insurer to accept certain uniform mitigation
38 verification forms; providing a criminal penalty for
39 knowingly submitting a false or fraudulent mitigation
40 form with the intent to receive an undeserved
41 discount; providing an effective date.
