    1                        A bill to be entitled                      
    2         An act relating to cable and video services; amending
    3         s. 610.119, F.S.; extending one of the dates by which
    4         the Office of Program Policy Analysis and Government
    5         Accountability is required to submit a report on the
    6         status of competition in the cable and video service
    7         industry; clarifying that two reports are to be filed;
    8         requiring that the reports contain certain
    9         information; requiring that cable and video service
   10         providers submit certain information to the Office of
   11         Program Policy Analysis and Government Accountability
   12         by specified dates to facilitate the completion of the
   13         reports, if not prohibited by federal law or exempt
   14         from the public-records law; providing an effective
   15         date.

   17  Be It Enacted by the Legislature of the State of Florida:
   18  
   19         Section 1. Section 610.119, Florida Statutes, is amended to
   20  read:
   21         610.119 Reports to the Legislature.—
   22         (1) The Office of Program Policy Analysis and Government
   23  Accountability shall submit to the President of the Senate, the
   24  Speaker of the House of Representatives, and the majority and
   25  minority leaders of the Senate and House of Representatives, by
   26  December 1, 2010 2009, and December 1, 2014, two reports a
   27  report on the status of competition in the cable and video
   28  service industry in 2010 and 4 years thereafter, including, by
   29  each municipality and county, the number of cable and video
   30  service providers, the number of cable and video subscribers
   31  served, the number of areas served by fewer than two cable or
   32  video service providers, the trend in cable and video service
   33  prices, and the identification of any patterns of service as
   34  they impact demographic and income groups. In addition to
   35  assessing the changes in competition, each report shall identify
   36  the:
   37         (a)Total number of cable providers offering services in
   38  Florida;
   39         (b)Total number of video service providers offering
   40  services in Florida;
   41         (c)Total number of cable subscribers served by each
   42  provider;
   43         (d)Total number of video subscribers served by each
   44  provider;
   45         (e)Number of areas served by fewer than two cable or video
   46  service providers;
   47         (f)Trends in prices for cable and video services from 2009
   48  to 2014; and
   49         (g)Patterns of service and its impact on certain
   50  demographic and income groups.
   51         (2)In order to facilitate the timely completion of the
   52  reports, each cable services provider and video services
   53  provider offering services in the state on or after January 1,
   54  2008, or as of January 1 of any year thereafter until January 1,
   55  2014, shall submit to the Office of Program Policy Analysis and
   56  Government Accountability, in delimited text files, by June 30,
   57  2009, and every year thereafter until June 30, 2014, the
   58  following information, only if the submission of such
   59  information does not violate federal law and the information is
   60  exempt from the requirements of the public-records law in
   61  chapter 119:
   62         (a)The aggregate number of cable subscribers served by
   63  each provider by zip code;
   64         (b)The aggregate number of video subscribers served by
   65  each provider by zip code; and
   66         (c)Annual price reports containing the regional price
   67  differences in the state for the full list of service pricing
   68  alternatives offered by the provider as of each year for the
   69  four quarters ending June 30, including basic residential cable
   70  or video services and packaged cable and video products.
   71         (3)(2)By January 15, 2008, The Department of Agriculture
   72  and Consumer Services shall make recommendations to the
   73  President of the Senate, the Speaker of the House of
   74  Representatives, and the majority and minority leaders of the
   75  Senate and House of Representatives regarding the workload and
   76  staffing requirements associated with consumer complaints
   77  related to video and cable certificateholders. The Department of
   78  State shall provide to the Department of Agriculture and
   79  Consumer Services, for inclusion in the report, the workload
   80  requirements for processing the certificates of franchise
   81  authority. In addition, the Department of State shall provide
   82  the number of applications filed for cable and video
   83  certificates of franchise authority and the number of amendments
   84  received to original applications for franchise certificate
   85  authority.
   86         Section 2. This act shall take effect July 1, 2009.
