    1                        A bill to be entitled                      
    2         An act relating to commercial motor vehicles; amending
    3         s. 316.535, F.S.; increasing the maximum weight limits
    4         on certain vehicles to compensate for weight increases
    5         that result from the installation of idle-reduction
    6         technologies; providing an effective date.
    7         
    8  Be It Enacted by the Legislature of the State of Florida:
    9         
   10         Section 1. Present subsections (3), (4), (5), (6), (7), and
   11  (8) of section 316.535, Florida Statutes, are renumbered as
   12  subsections (4), (5), (6), (7), (8), and (9), respectively, a
   13  new subsection (3) is added to that section, and present
   14  subsection (8) of that section is amended, to read:
   15         316.535 Maximum weights.—
   16         (3)(a)The maximum gross vehicle weight and the axle weight
   17  limit for any commercial motor vehicle equipped with idle
   18  reduction technologies shall be increased by a amount, not to
   19  exceed 400 pounds, which is necessary to compensate for the
   20  additional weight of the idle-reduction technologies.
   21         (b)Upon the request of a regulatory agency or law
   22  enforcement agency, a vehicle operator shall provide proof
   23  through demonstration or certification that:
   24         1.The idle-reduction technologies on the vehicle are fully
   25  functional at all times; and
   26         2.The 400-pound gross weight increase is not used for any
   27  purpose other than the idle-reduction technologies.
   28         (8) Except as otherwise hereinafter provided in this
   29  section, a no vehicle or combination of vehicles exceeding the
   30  gross weights specified in this section may not subsections (3),
   31  (4), (5), and (6) shall be permitted to travel on the public
   32  highways within the state.
   33         Section 2. This act shall take effect July 1, 2009.
