A penalty of $3,000 for failure to timely upgrade a 10 storage tank system or to timely assess or remediate petroleum 11 contamination as required by department rule.The department12shall assess13 3. A penalty of $2,000 for failure to conduct or maintain 14 required release detection; failure to timely investigate a 15 suspected release from a storage system as required by 16 department rule; depositing motor fuel into an unregistered 17 storage tank system;failure to timely assess or remediate18petroleum contamination;or failure to properly install a 19 storage tank system.The department shall assess20 4. A penalty of $1,000 for failure to properly operate, 21 maintain, repair, or close a storage tank system. 22 (h) For contaminated site rehabilitation violations, the 23 department shall assess: 24 1. A penalty of $5,000 for failure to submit a complete 25 site assessment report; for failure to provide notice of 26 contamination beyond property boundaries or complete a well 27 survey as required by department rules; for the use or injection 28 of substances or materials
