The Committee on General Government Appropriations (Aronberg)
recommended the following:

3 Delete lines 660 - 682
4 and insert:
5 rule; for failure to submit a site assessment report; or for
6 failure to conduct remediation or monitoring activities until a
7 no-further-action or site-rehabilitation completion order has
8 been issued. The department shall assess
9 2. A penalty of $3,000 for failure to timely upgrade a
10 storage tank system or to timely assess or remediate petroleum
11 contamination as required by department rule. The department
12 shall assess
13 3. A penalty of $2,000 for failure to conduct or maintain
14 required release detection; failure to timely investigate a
15 suspected release from a storage system as required by
16 department rule; depositing motor fuel into an unregistered
17 storage tank system; failure to timely assess or remediate
18 petroleum contamination; or failure to properly install a
19 storage tank system. The department shall assess
20 4. A penalty of $1,000 for failure to properly operate,
21 maintain, repair, or close a storage tank system.
22 (h) For contaminated site rehabilitation violations, the
23 department shall assess:
24 1. A penalty of $5,000 for failure to submit a complete
25 site assessment report; for failure to provide notice of
26 contamination beyond property boundaries or complete a well
27 survey as required by department rules; for the use or injection
28 of substances or materials
